Land is the basic means of agriculture production. However, with the deepening of theindustrialization and urbanization in China, decentralized management due to fragmented land inagfrariculture has been unable to meet the requirements of agricultural modernization, which ischaracterised with large-scaleness, organization, market-orientation, efficiency, and the householdcontract responsibility system has been gradually losing its power. So it is imperative to carry out thereformation of rural land and push the agricultural land contract management to transfer.This research studied the transfer mechanisms of the agricultural land contract management rightthrough literature analysis, theoretical analysis and empirical study. The three regions selected in theempirical study are representative regions of developed agriculture, city suburbs agriculture, and thetraditional agriculture. Then, it analyzed the current situation of the transfer mechanisms of theagricultural land contract management right in the three regions, covering specifically the transfermethods and patterns, willingness of farmers to transfer land and the influence factors, the transfer priceand land dispute handling. In the end, based on the analysis of the methods of rural land transfer inforeign countries, the study put forward policy suggestionsFirstly, it compared the various modes of the transfer of the agricultural land contract managementright using the theory of property rights. The result showed that three modes of the transfer of theagricultural land contract management right, namely,“transfer spontaneously in private of farmers”,“transfer driving by the government”, and “transfer driving by the market” existed respectively in thepreliminary, the intermediate, and the advanced stage of social development, and adapted to differentlevels of economic development in different areas.Secondly, it analyzed solutions to land dispute using legal economics theory, and it showed that thecost of dispute mediation system was low in the aspect of legislation cost, economic cost, time cost,relationship cost, recessive cost, and social cost.Thirdly, it analyzed the factors affecting farmers’ behavior of transfer of the agricultural landcontract management right in depth,and the result showed that the main factors affecting the farmers’outflow and inflow behavior of agricultural land were different among the three regions. It analyzed thefarmers’ ouflow behavior of the agricultural land contract management right using the LOGITregression model. In Yiyang county, Luoyang city, Henan province, the main factors included farmers’employment status, family income level and social security situation. In Xishan district, Wuxi city,Jiangsu province, the main factors included the age, the culture level of farmers and farmland resourcesendowment. However, in Yuanzhou district, Guyuan city, Ningxia Hui Autonomous Region,the mainfactors included family labors, family income levels and farmland resources endowment. In terms offactors hindering farmers’ inflow behavior in the agricultural land contract management right, it alsoshowed the regional differences. In Yiyang county, Luoyang city, Henan province, the main factorsincluded small per capita arable land, the lack of agricultural cooperatives or professional associations, and the weak involvement of the government. In Xishan district, Wuxi city, Jiangsu province, the mainfactors included scarce land resources, strong interference of the grassroots government and limitationof agricultural production technology. In Yuanzhou district, Guyuan city, Ningxia Hui AutonomousRegion,the main factors included the lack of human resources, high labor cost, and the lack of financialsupport.Fourthly, it estimated the price of transfer of the agricultural land contract management right whichwas ought to be using the income reduction method. It showed that the actual price was lower than themeasured price. In Yiyang county, Luoyang city, Henan province, the actual price was RMB265.06,and the measured price was RMB356.41. In Xishan district, Wuxi city, Jiangsu province, the actualprice was RMB874.89, and the measured price was RMB2665.00. In Yuanzhou district, Guyuan city,Ningxia Hui Autonomous Region, the actual price was RMB202.99, the measured price was RMB256.53.Finally, it summarized the methods of agricultural land transfer in Japan and India. Combined withanalysis above, then it put forward the countermeasures and suggestions to improve transfermechanisms of the agricultural land contract management right, including strengthening land real rightfunction, improving the level of social security, promoting the transfer of rural population in macroaspects as well as regulating and guiding the outflow and inflow behavior of farmers, improvingintermediary service, reforming price mechanism and developing the mediation system in microaspects.
