A Research Of The Translation Between Chinese And English Legal Text

Legal text is the carrier of legal meaning,information and carries out legal purpose.It distinguishes itself from other texts in features.The translation between Chinese and English legal text is the transformation of legal meaning and information between Chinese language and English language.It is impossible for different countries to conduct the exchanges without legal translation.Legal translation is a complicated process in which different languages,different cultures,different societies,and different thinking modes are mixed with each other.These differences result in many legal translation problems which make it difficult to carry out the exchanges between China and foreign countries.In order to deal with the problems in translation,to improve the translation theories,especially to promote the legal text translation between Chinese language and English language,the dissertation will be made representatively in lexical,sentential and textual stratifications in the two languages and make a research for the features in Chinese legal language and English legal language,during which analyses will be made to found out the factors that influence legal translation between Chinese and English culture,society and thinking.And then,the dissertation is to search for the disciplines of the translation of legal texts and to suggest the strategies to encounter the differences in the two languages.As a result,the dissertation will supply the useful references to and make contribution to the development of translation theory and practice.The dissertation is composed of three parts: introduction,the main part and the conclusive remark.The introduction is chapter one.This part is to discuss the causes for the desertation,thinking styles,aim,significance and the methods of the research.The main part is composed from chapter two to chapter seven.Chapter two is a study of translation history and translation problems.Because of many factors,there are many problems which greatly influence legal text translation.Chapater three reviews the relevant translation theories such as Functional Equivalent Theory,Systemic,Functional Theory,Relevance Theory and some Chinese classic viewpoints in translation.These theories and the relevant study function as the foundamental framework for the research of legal text translation.In this chapter,text theories and legal text theories related are put into the study.Both of the studies provide the desertation with comparatively overall and profound ground for the study of legal text translation.From chapter four to chapter six,the dissertation detailedly makes a reseach of the features and the differences in lexicon,syntax and text in Chinese and Engish language.In this part,the features and the differences in legal words,legal sentences and legal text are worked out.And the factors and the mechanism are searched in the way in which the influence functions in words,sentences and legal texts,and anslyses are made in translation.In chapter seven,the disciplines and the strategies in legal text translation are proposed.The disciplines are faith,accuracy,concision,identity,emotion-removing which should be observed in legal text translation,and the strategies such as literal translation and free translation,domestication and foreignization,division and interpretation,inconicity,creation-cautioned are mainly adopted in lagal text translation.The conclusive part is chapter eight which the conclusion makes a brief summary,and discusses the problems unsolved and makes a plan for the future research.
