Research On Internal Dispute Resolution Mechanism Of Football Associations

Along with the socialization and commercialization of football games, more and more complicated disputes are arising in this field. Compared with other type of sporting disputes, the resolution of football disputes rely heavily on the internal dispute resolution mechanism of football associations. As far as the football disputes concerned, the internal dispute resolution mechanism of football associations has been proved to be the most important and effective one among different dispute resolution mechanisms. Hence, the author choose "the internal dispute resolution mechanism of football associations" as the theme of this dissertation, so as to probe into the main institutions and fundamental regularities of football disputes resolution. Based upon the rationale of the internal dispute resolution mechanism of football associations, this research investigates the internal dispute resolution mechanisms of FIFA and some national football associations, and finally puts forward the preliminary conceptions and suggestions for the perfection of internal dispute resolution mechanism of Chinese Football Association.This research can be divided into three parts:the preface, the main body and the epilogue. And the main body of this research is made up of5chapters as follows:Chapter One defines the basic concepts of this research. Firstly, it illustrates the connotation of "football association","dispute","sporting dispute","sporting dispute resolution mechanism", and discusses the nature of the Chinese Football Association. Secondly, it makes a comparison between the internal dispute resolution mechanism and the external dispute resolution mechanism. Finally, it analyzes the origin of the formation of internal dispute resolution mechanism of sports associations, and investigates the constituents, that is the basic principles, the subject, the object, the procedure and the supervisory mechanism of the internal dispute resolution mechanism of football associations.Chapter Two explores the foundation theory of the internal dispute resolution mechanism of football associations. This chapter makes an in-depth reflection on the foundation theory of the internal dispute resolution mechanism of football associations from the dimensions of "government-associations" and "associations-members", and points out that "Governance Theory" and "Social Contract Theory" are the foundation theories for the internal dispute resolution mechanism of football associations.Chapter Three analyzes the internal dispute resolution mechanism and practice of FIFA. Firstly, this chapter deconstructs and inspects the dispute resolution institutions inside FIFA in the order of "dispute resolution body","dispute jurisdiction scope","applicable law and rules","procedures to be obeyed". Secondly, it discusses the practice of the Dispute Resolution Chamber (DRC) and the Players'Status Committee (PSC) through the cases published on the official website of FIFA. In the part of institutional destruction, the disputes jurisdiction scope of DRC, PSC and the Appeal Committee, as well as the specific procedures is clearly designated and differentiated.Chapter Four gives an overview of the internal dispute resolution mechanism of "the Football Association","South African Football Association" and "Football Federation Australia" also in the order of "dispute resolution body","dispute jurisdiction scope" and "procedures to be obeyed".Chapter Five discusses the construction and perfection of the internal dispute resolution mechanism of Chinese Football Association (CFA). After probing into the internal dispute resolution mechanism of CFA in force, this chapter then examines the defects of the present football management system and the specific institution, and by using FIFA's National Dispute Resolution Chamber Standard Regulations as the model rule, finally puts forward the propositions for the improvement of the internal dispute resolution mechanism of CFA.
