The construction of Cheng Yi's Neo-Confucianism is based on his new Yi-learning,and is realized by the prospect of heaven and human,the principle of humanity and destiny,the way of three materials and the new connotation of the cultivation.Therefore,Yi-learning is an important component of Cheng Yi's philosophy."Zhou Yi Cheng Shi Chuan" is a representative of his Yi-learning.Under the perspective of the vitality of things,Cheng Yi constructed an orderly world where the same principle is shared by things and the heavens and circulated.In order to return to the original teachings of Confucius and Mencius,he proposed a set of rule of rites,which was based on principle,took "Noumenon and Expression are real existence" as outline and the internal saints and external kings as main contents.The aim of this article is to discover and excavate the core content of Cheng Yi's philosophy of etiquette and law,which is about the construction of the relationship between heaven and man,reconstruction of political order and the ethical cultivation,in the perspective of the blending of Yi-learning and Neo-Confucianism.Since Confucius created a tradition of benevolence and rites,Xunzi focused on the rites and Mencius focused on the benevolence.With the help of ritual studies,the system of rituals and laws was established in Han and Tang Dynasties.Confucians in Song and Ming dynasties made explanations on this issue at a more abstract level and thus elevated the traditional Confucian theory of etiquette and law to a new realm.Cheng Yi combined the issue of etiquette and law and the relationship between principle and desire,righteousness and interest and public and private into one around how to reconstruct the ideology of Confucian moral ontology and serve the social and political ideals of" internal saints and external kings ".In order to find the place and meaning of human and rituals in the cycle of integration of all things,Cheng also want to integrate the various ideas of the sages into a set of discourse frameworks under the category of "Yi,Principle,Benevolence and Rites".Master Yichuan believes that the people in reality should conform to the requirements of the principle,and realize"Restrain oneself and restore rites to return to Benevolence" and rituals and achieve the harmonous realm between man and nature in the process of the cultivation of the heavens and the earth.While constructing his etiquette-law system,he proposed a path of moral practice to achieve "inner transcendence",and strive to explain and find a way out for the political activities in danger and the confusion of social life.This dissertation places etiquette-law as the ancient Chinese legal philosophy according to the methods of Yu Ronggen,Ma Xiaohong,and Song Daqi.Cheng Yi's philosophy of etiquette-law is the specific application of his philosophy of principle and Yi in the field of ritual and law.The research content includes the ethical and legal categories of Yi.Principle,Benevolence.Mind,Etiquette,Law,etc.,and gradually develops into a research framework of legal philosophy.This dissertation consists of six parts.The first chapter is about the definition of etiquette and law and the interpretation of the theory of etiquette-law.First of all,the scope of the etiquette and law is clarified to find the position of ritual law in the ancient Chinese law.This article believes that the etiquette-law is the ancient Chinese law.In the perspective of the integration of Yi-learning and Neo-Confucianism,this chapter explores the research scope of Cheng Yi's etiquette-law studies,and outlines the research system and framework integrating the noumenon source of the etiquette-law,the human nature of the etiquette-law,the tension and conflict of the etiquette-law itself and realistic presentation of the etiquette-law on human-being.The reality presents four fundamental internal.Through positioning the relationship between Yi and principle,principle and mind,mind and benevolence,benevolence and etiquette and etiquette and penalty,this chapter introduces the construction way of Cheng Yi's etiquette-law,which starts from the origin of the principle cycle,and completes the direction and goal of etiquette-law under the inner drive of principle and desire.The second chapter,Yi(changes)and Li(principle):The principle basis of Cheng's etiquette-law theory.Through the interpretation of the relationship between Yi and Li,it seeks the principle basis of Cheng Yi etiquette-law.Through the opening of the new world picture in the context of Yi-learning,the relationship between heaven and human in the perspective of Yi-learning became the ontology foundation of the construction of Cheng Yi's Neo-Confucianism.On the basis of the unified examination of the categories of Yi.Dao and Shen,it introduces how Cheng Yi constructs a Confucian classic theory system that integrates principle and life.Through the elaboration of the relationships between principle and things,principle and image,and principle and implement,the author further deduces Cheng's ontology of "substance and function share the same origin,and the apparent and the subtle are inseparable",which also marks the formation of Cheng Yi's etiquette-law ontology."Tianli(principle)" has become the foundation of the changeable world and the ontological basis of Cheng's etiquette-law philosophy.The third chapter,Li(principle)and Li(etiquette):the realistic presentation of Cheng's theory of etiquette-law.Cheng Yi believes that the origin of the "etiquette" as a social norm is still "principle"."The etiquette means the principle" is the position of the relationship between the principle and etiquette,and thus it realizes the connecting between heaven order and human regulation.The order of heaven and earth is the noumenon of etiquette;the harmony of heaven and earth is the function of etiquette.The spirit of etiquette is the perfect combination of the order and harmony under the principle that presents the harmony of heaven and earth.This chapter further explores"moderate and righteousness" from the relationship between the order and harmony.Through the interpretation of "moderate and righteousness" in the ontology and cosmology,it shows Cheng Yi's way of "Dazhong" that is "Moderate is the principle and the way".And the quality of "strongly moderate and righteousness" is the law of Cheng Yi's humane order.The fourth chapter,Xing(nature)and Ren(benevolence):the human nature of Cheng's theory of etiquette-law.This chapter is an explanation to the relationship between the nature and the benevolence of Cheng Yi's etiquette-law philosophy.The implementation of principle into human beings is the principle of nature and destiny of the individual in the universe.Through the integration of "nature is the principle",Cheng Yi seeks the basis for the goodness of human nature and constructs the metaphysic of benevolence;through the metaphysical construction of benevolence,Cheng realizes the fusion of the life noumenon and the moral noumenon,and the transition from principle to humanity.Etiquette is the externalization of benevolence and benevolence is the inner spirit of etiquette-law,which is the rule requirement from human nature.The theory of good nature under Cheng Yi's benevolence noumenon not only lays a human nature foundation for the moral practice of etiquette-law,but also provides rational basis and theoretical support for the two-way construction of the relation,"explaining benevolence with public" and "education of benevolence and etiquette" highlights the characteristic of Cheng Yi's moral benevolence theory.The fifth chapter,Li(principle)and Yu(desire):the inner tension of Cheng's etiquette-law theory.This chapter explores the inner mechanism of Cheng Yi's,etiquette-law by analyzing the relationship between principle and desire.The etiquette-law theory of "restoring the principle and destroy ing human desires" is deeply rooted in the fact that human behavior is subordinated to the rationality of heaven principle.Principle-desire,the most important manifestation in social relations,is public-private relations.The public-private debate on public-oriented thought is the development of Cheng Yi etiquette-law theory.The relationship between righteousness and benefit is closely related to public-private relations.The Public Interests doctrine of justice-based is the deepening of Cheng Yi's view of etiquette-law.Thus the etiquette-law meaning of Cheng Yi's debates on public and private interests is to find a theoretical basis for social behavior rules.The inner tension of principle and desire establishes the standard of the etiquette-law regulation in the principle and content of the etiquette-law.The unified value system of "Multiple Modes Shares a Single Substance" has achieved the organic unity of the order of etiquette-law.The sixth chapter,Li(principle)and Fa(law):the internal and external communication of Cheng's etiquette-law theory.This chapter discusses the external characteristics of Cheng Yi's etiquette-law theory.Through the discussion of the relationship between the evolution of rites and punishments,and the relationship between etiquette and law,it shows how the principle evolved from the way of heaven and earth to the rules of the world's etiquette-law.It also explores the etiquette-law as a political order and behavioral norms and the presenting principle under the regulation of heaven principle and in the perspective of Yi-learning and Neo-Confucianism."The law is the utility of way" is the positioning of Cheng Yi's etiquette-law relationship.Through the practical application of etiquette-law and practical summary of individual politics,this chapter introduces a set of practical applications principles which reflects the consistent character of Cheng Yi's etiquette-law.In short,Cheng Yi's etiquette-law theory is an ancient Chinese legal philosophy that combines "the unity of heaven and human","the unity of benevolence and etiquette","the inner saint and extern king" and etiquette-law.Heaven principle is applied to the human world from two directions:One is the objective social rules,that is,the norm of etiquette-law.The other is the inner nature of human beings,that is,benevolence and virtue.The two evolutionary directions are one and the same.In the practice of etiquette-law,people can consciously realize the return to the heaven principle and the unity of inner and outer,heart and nature and the value and the order.
