Research On Implementing Popularizing-law Education

In this new era,the key procedure of building a better life is to ensure every dimension of governance based on law.A mature rule of law culture is the precondition to advance law-based governance.The institution of popularizing-law education is a crucial path to provide rule of law education,to cultivate law-governing values and to build rule of law culture.However,this institution has not achieved this goal.The gap between reality and ideality requires a much deeper analysis into this subject.T his thesis tends to provide some new ideas in the background of a new era: Firstly,this thesis regards the popularizing-law education as an institution and analyses how it develops from embryo to transformation.As a crucial part of the rule of law socialization,this institution influence public in many ways.Secondly,this research applies creative methods.To answer the question that what effects have been brought out,it needs much more empirical research.This essay develops and applies an evaluation index system about the effects of the institution.Finally,some suggestions are given to improve the institution.They are clear principals about how to design this institution;contents and operating mechanism need to be improved.The establishment of this institution is marked by the plan of popularizing-law education coming out in the year of 1985.The CPC and government have gained experience from previous similar practices.Those experiences have shown incomprehensibility of treating the popularizing-law education as a political movement.They also demonstrate necessity to generalize this movement.Since the establishment of this institution,there have been seven plans came out.Based on the investigation to those practices,this essay finds out that during the thirty and more,there is a transition from the campaign-style popularization to the institutionalized popularization.The focuses and contents of those plans changed according to requirements of governance and needs of people.Particularly since the law-based governance became a statecraft,this institution provided education rather than traditional rule by law education but rule of law education.Also,it focuses on popularizing values of lawbased governance to build a rule of law culture.However,this transition is unfinished which hinders the consequences of building rule of law culture.Till now,our society does not have a mature rule of law culture that could meet the demands of law-based governance.To improve this status,we can set about from both sides: On one hand,this institution faces difficulties in terms of implementation.These including following problems.Biases exist in rule of law concepts which leads to poor explanation.Also,path dependence exits.And there is an interest relationship between the implementation actors and the receivers.Finally,some receivers are not used to govern by law.On the other hand,the institution's internal problem also plays a role,such as plans' defects,lacking contents corresponding to demands in this new era,and lacking effective mechanism.This essay explores reasons that lead to this phenomenon,which is theory detached from practice.That it to say,we have to apply the theory of socialist rule of law with Chinese characteristics and the theory of rule of law socialization.Specifically,there are five suggestions.First of all,makes it clear that the formulating principals are following: theory of socialist rule of law with Chinese characteristics,humanism and operability.Secondly,this institution should include contents about this new era,targeted groups and diversity.Thirdly,we should improve mechanism by rely on rule of law theory.Moreover,we should establish a proper evaluation system,such as applying third party evaluation,accountability system and public participation.Finally,it would also be helpful to draw on the experience of how American's law-related education has been implemented.That is to say,the popularizing-law education institution could be improved by providing qualified and pragmatic contents,and by encouraging professionals to participate.In this new era,research done to improve the popularizing-law education is crucial to promote rule of law culture construction.We have to raise public awareness of the law to cultivate mature rule of law culture and to advance law-based governance.
