During the early time when the the People's Republic of China was initially established,it was the new mission and new challenge faced by the Chinese Communist party after the great victory of revolution to remold and reconstruct the semi-colonial and semi-feudal old China which was suffering from great poverty and backward development into a thriving and powerful socialist New China,to tightly combine the Marxism Fundamental Theory with the specific practical situation of China,and to explore an unprecedented road for innovative development.Family serves as the cell of the society.As a part of semi-colonial and semi-feudal old China,the old marriage family system imprisoned women and most men,which became the root of family misery.The abnormal and backward social morality in feudal society,along with its social customs and weary social general mood of semi-feudal society were all reflected in the old marriage system and relevant customs.Therefore,to reform the old marriage family system and build a new democratic marriage family system was an important,urgent and primary mission for the social revolution of New China.Before the establishment of the People's Republic of China,the marriage family system of Old China under the feudal patriarchal system regarded the authority of father and husband as its center,characterized by arranged marriage,women inferior to men and neglecting children's interests.The marriage revolution happened in modern days couldn't change that situation.The feudal marriage system and customs are still pretty common around China including Shaanxi province.The Marriage Law in 1950 was the first law issued after the founding of the People's Republic of China,aiming at destroying the feudal marriage customs and system and implementing the new democratic marriage system.But after the establishment and implementation of the Marriage Law,the old marriage customs,like arranged marriage,mercenary marriage,early marriage and child bride,etc.were still very common around China including Shaanxi province.Meanwhile,divorce cases and divorce disputes increased a lot,leading to the family and social instability.The marriage freedom was interfered,which caused many serious social problems like women suicide,etc.How to make sure the Marriage Law can be implemented without any resistance became a problem of the communist party and our government which must be resolved.Based on the investigation of the implementation of the Marriage Law,it can be considered that the main resistance is the old feudal marriage system and feudal marriage thoughts were deeply rooted in some people's heart.Therefore,it was decided that we should continue to put propaganda and education as well as political movement into practice to solve this problem,fully promoting and implementing the Movement of the Marriage Law from the end of 1951 to March,1953.The Administrative Office of the Central People's Government carried out the Movement of the Marriage Law in a systematic and systematic manner under the leadership of the Party Central Committee of Communist Party of China.Shaanxi Administration conducted the Movement of the Marriage Law in Shaanxi Province in accordance with the instructions of the Administrative Office of the Central People's Government.The Marriage Law underwent three stages including initial phase(from April,1950 to September,1951),development phase(from September,1951 to December,1952)and peak phase(from January,1953 to April 1953)successively.The Mobilization Committee for the Movement of the Marriage Law,composed of leaders from Publicity Department of the Communist Party of China,All-China Women's Federation,Ministry of Justice of the People's Republic of China,Ministry of Civil Affairs of the People's Republic of China,and Ministry of Education of the People's Republic of China,was a specialized leading organization for the movement.Under the deployment and leadership of Mobilization Committee for the Movement of the Marriage Law,that movement was featured with the basis with the organization,learning and training of cadres,propaganda service as main method and approach,All-China Women's Federation as powerful assistant,and the service of justice as a powerful guarantee for the implementation of the Movement of the Marriage Law,all forces useful were utilized for mobilization with the aim of achieving the success of the social revolution in the field of marriage and family in New China.Because the Movement of Marriage Law involves the family members privacy and intimacy,which touched and shook the old family authority such as the paternity and the authority of the husband,while poor quality and inexperience of some grass-roots cadres existed,causing certain contradictions and conflicts between women and men,husbands and wives,parents and children,mothers-in-law and daughters-in-law.For example,the grass-roots cadres are not only executors of the Marriage Law,settlers of family disputes,but also barriers of the Movement of the Marriage Law;some cadres incited family conflicts for preventing women from divorcing or properly handling family conflicts,causing the resentments among the masses;some men and women freed from arranged&mercenary marriage and realized the freedom of marriage by virtue of the provisions of the Marriage Law on the divorce,and some people got divorced at will because of their fickleness in affection,causing divorced rural women or poor men into life difficulties;some of the married women have obtained equal status in the family during the Movement of the Marriage Law.Some daughters-in-law even gained powerful position in the family by making use of the Movement of the Marriage Law.In turn,they suppress and even abused their parents-in-law.Actually,these complicated situations were masks of superincumbent "National Perspective" on the complexity and specificity of the underclass in the Movement of the Marriage Law.Even through the time has passed,it is necessary to examine the Movement of the,:Marriage Law with objective and sympathetic perspective today.Compared to contemporaneous agrarian reform movement,the Movement of the Marriage Law is one of numerous mass movements in the early days of New China,showing common characteristics of mass movements,but the two also showed different characteristics,namely different objects of movements and specific methods,varied levels of intensity,different quantification standards,varied criticality and importance,and different results and effects.These differences demonstrated that the Movement of the Marriage Law was different from the uniqueness and complexity of economic reform.It indicated that the founders and rulers of New China would face more severe challenges and greater challenges than simply political and economic struggles.It enabled the Chinese Communist Party to explore a path of modernization that was different from other countries,namely the socialist road with Chinese characteristics.The marriage and family reforms from the top down promoted in the manner of mass movement is in line with actual practice and exploration of Chinese society.Although the reform face heavy traditions and interweaves difficulties in real interest as well as the complexity of marriage and family issues,great achievements have been made through the efforts in a short time.The reforms basically abolished backward feudal marriage systems,and the new-democratic marriage-family system has been initially established.new concepts and styles of marriage and family have gradually emerged;the Movement of the Marriage Law has further liberated women;the Movement of the Marriage Law delivers strengthened national concept and political consciousness of farmers and nurtured new socialist citizens.These achievements reflect successful practices of Marxism in China in the field of marital reform.Meanwhile,it is of historical limit,namely the contradiction between the Movement of the Marriage Law and the persistence&complexity in the reform on the marriage and family.The Movement of the Marriage Law leads to the politicization of law and the administration of justice.According to the specific research on the Movement of the Marriage Law in the 1950s,it is concluded that it is extremely arduous for Chinese Communist Party to build New China.The exploration and practice of the modernization process with Chinese characteristics is witnessed under the guidance of Marxist theory.And there are not only successful experiences but also unforgettable lessons.It is a correct attitude for the Chinese Communist Party and China to remember and conclude the history in realizing the Chinese dream and the great rejuvenation of the Chinese nation.
