Cruise ship originated in Europe and cruise tour became prosperous in North America. Contemporary cruise voyages gained popularity in the 70s of the 20th Century and contributed gradually to the formation of cruise home ports. Contemporary cruise liner is floating resort on the sea, which has become a unique vacation space that is global and network-like in nature. Such vacation space provides opportunities for passengers to immerse into nature, experience slow-pace life, understand foreign cultures, expand sea power and explore oceans. Cruise liners are aimless destinations. The cruise industry has seen an annual growth of 7.4% regarding the number of cruise liner tourists since 1990 and has become the fastest growing segment in global tourism industry. The economic and social benefits generated by cruise home port are 10-14 times as many as those of port of call. Cruise home port development is a strategic choice made by many coastal cities in the world. In recent years, global cruise market has shifted to the east. China enjoys a 18000-kilometer mainland coastline, and therefore coastal cities strive to learn international experiences and build cruise home port. Cruise economy develops extraordinarily quickly and has become a new momentum for port city transformational development.On the basis of exploring major development issues of China's cruise home ports, global trend of cruise tourism development and opportunities in this field in China, the thesis expounds on the theoretical and practical significance of the research. With the guidance of theories about legislation work, sustainable development, industrial structure and industrial gathering, by using methodologies in which global experience and China's reality are combined, theoretical research and practical analysis are combined, abstract study and specific case are combined and document research and field survey are combined, from the perspectives of law, economics, management and culture, this thesis strives to conduct a systematic research on China's cruise(tourism)home port development from the angle of regulation.The thesis first fully examines the evolution and regulation experience of global cruise(tourism)home ports and investigates the status quo of China's cruise(tourism)home ports and their problems of legislation, and after global comparison, the thesis tries to put forth some innovative ideas for overall planning, economic regulation, social regulation and strucrue formation of China's cruise (tourism) home ports. The intention is to stimulate development momentum, guarantee healthy development order, and ultimately realize sustainability and coordination on port's economic, social and environmental development. Ultimately the thesis uses Shanghai cruise(tourism)home port as a case study. The thesis is constituted by nine parts seven chapters.Under the conditions that there is no systematic research findings and references, the creative element of this thesis is that it uses the urgent and long-term government legislation demand as a research angle, makes cruise home port--the engine of cruise economic development--as research target, focuses on how to regulate and promote the sustainable, rapid and healthy development of cruise industry and extends cruise economic research and cruise(tourism) home port research in China into new fields and perspectives. Therefore, this thesis can provide theoretical support and be referred to when decisions concerning China's cruise(tourism) home port construction and legislation are made. This thesis points out that cruise(tourism)home port includes cruise liner pier and surrounding supportive areas, which is the originating port for cruise ships, the headquarter of cruise lines and the assembly area for passengers. The functions of cruise home port usually include basic functions, core functions and extensive functions. Borrowing international experience, considering China's market environment and regional conditions, and conducting SWOT analysis, this thesis proposes in a exploratory way that China's cruise(tourism) home port has four strategic development phases:start-up phase, phase for learning and exploration, phase for split and enhancement and phase for full-swing development. There are five development principles:universal coordination and resource integration; international experience reliance and self-innovation; reasonable layout and regional linkage; market-oriented and industrial integration; and service optimization and managerial enhancement. Three basic models are provided:cruise home port, port of call and small-scale port. Three implementation strategies are proposed:phase-by-phase development and port layout based on classification; policy introduction and construction of trial model state-level cruise(tourism)home port; establishment of classified planning at both national and regional levels and coordination of safeguard mechanism. The thesis proposes four principles for industrial policy restructuring--including opening development, relaxing regulations to accelerate development, conducting trial development, and following international rules and practices as well as an industrial policy framework in which nineteen items in ten aspects-including investment, planning, finance, cruise route, customs clearance, art, human talent and dedicated legislation--are to be relaxed. The thesis puts forth that social legislative strengthening for China's cruise(tourism) home port shall follow five principles including insisting public interests, integrated plan, foresight, development from simple to complicated and abiding by international practices, and shall have five measures including establishing home port development social feasibility verification mechanism, creating integrated development model for home port's cruise ship community, enhancing cultural environment of home port development, strengthening China's international judiciary capability in maritime field, and advancing improvement of relevant legal system and standardization in an orderly way. The thesis ultimately uses Shanghai cruise(tourism)home port as a case study to explore its development model, its regulations, development principles, various phase targets, port layout, policies and measures, with an intention to use Shanghai as a model for China's coastal cities.
