The Article of Research on departmental organic law of central government (hereinafter referred to as“the Article”) aims to put forward some suggestions for perfecting our country's departmental organic law of central government.The article makes the assumption that the central government has Self-interests. As long as the central government has Self-interests, it's possible that the central government will establish unnecessary departmental organizations. Therefore, the democratic country should empower the congress to establish departmental organizations, but not the central government. The article consists of four chapters.In the first chapter, the article introduces its studying background and methods. Then, the article defines such concepts as administrative organization, administrative organization law, departmental organic law of central government, power of organizing administration and so on. At the same time, the article makes the assumption that the central government has Self-interests.In the second chapter, the article reviews the history of our country's departmental organic law of central government since 1949, and then makes an analysis of the legislative reasons, characteristics, content and status of implementation of our country's departmental organic law of central government. It's finded that, in fact, the state council has grasped the power of establishing department organizations and self-organized from time to time since 1982. In the third chapter, on the basis of comparative research on the departmental organic law of central government in USA, UK, Japan, France and Germany, the article puts forward the principle of organizing administration according to law. In view of the fact that the constitution of 1982 empowers the NPC to establish the department organizations of central government, the article points out that our country should also establish the principle of organizing administration according to law.In the fourth chapter, the article puts forward how to develop our country's departmental organic law of central government. At last, the article studies the content of our country's departmental organic law of central government in the future in detail.
