A Study Of Legal Guarantee For China-russia Trade Facilitation

China-Russia trade is a bilateral trade between two major countries,which plays a special role in the respective trade structures of China and Russia and is highly valued by the two countries.For China,building the “Belt and Road” initiative is an important choice to open up a new foreign economic pattern.Therefore,developing China-Russia strategic cooperation partnership and continuously deepening China-Russia economic cooperation are the important link in building the “Belt and Road”.For Russia,both its“Turning to the East” strategy and the implementation of the Eurasian Economic Union strategy cannot be separated from the significant support of China-Russia trade.China-Russia trade is very important and must be promoted to advance smoothly.Trade facilitation is a key factor in promoting the smooth development of China-Russia trade.There must be legal guarantee to realize China-Russia trade facilitation.This paper studies the legal guarantee of China-Russia trade facilitation from the interdisciplinary perspective of law and economics,and adopts historical analysis,comparative analysis,empirical analysis and normative analysis to analyze and sort out the history and current situation of trade development and the influencing factors of China-Russia trade relations on the basis of the international trade theory and international trade law basic theory;builds the evaluation index system of China-Russia trade facilitation level and conducts empirical evaluation;analyzes the influence mechanism of China-Russia economic and trade laws on China-Russia trade facilitation;finally,puts forward suggestions to strengthen the legal guarantee of China-Russia trade facilitation.China-Russia trade has had a fine momentum of development,which is the result of a long period of exploration and run-in.After the founding of the People's Republic of China,China-Soviet economic and trade cooperation once had a good stage of development,but after the 1960 s,the trade between the two countries entered a period of stagnation.After the collapse of the Soviet Union,China and Russia focused on the development of bilateral trade and actively promoted various forms of economic and trade cooperation.And especially with the establishment of the China-Russia strategic partnership of coordination,the two countries have a solid political foundation for developing trade,and trade relations have developed in closer,deeper and broader directions.However,in the development of China-Russia economic and trade relations,there are still many adverse factors affecting the development of the trade facilitation of the two countries,i.e.,the trade facilitation level of the two countries still needs to be lifted.China-Russia economic and trade cooperation has broad fields and various forms of trade,including border trade,product trade,service trade,park development and so on,which have promoted the expansion of the scope of China-Russia economic and trade cooperation and the growth of trade scale.However,the current scale of the trade between China and Russia is far from the demonstration of the fine relations established by the two countries,nor does it fully release the trade potentials of the two countries.The reason is to a large extent attributed to some existing obstacles to the trade between the two countries and low level of trade facilitation.There are many factors affecting the trade facilitation between China and Russia.The reasons are the weak complementarity of the economic structures,the technical barriers to trade,the lack of cohesion of the trade system,and even the cultural aspects of the two countries.These reasons affect the development of trade between China and Russia from different aspects,and also cause many problems concerning insufficient trade facilitation.Improving the trade facilitation degree of China and Russia is a necessary means to unleash the trade potentials of the two countries.The key to enhancing the trade facilitation between Chian and Russia lies in some institutional breakthroughs,among which the core is the legal system on economic and trade relations.Strengthening China-Russia legal cooperation is conducive to the improvement of the efficiency of ports and the customs environment,speeding up the construction of cross-border infrastructure,promoting the cooperation on information and communication technologies,and optimizing the business environment.Nevertheless,China and Russia have made much important progress in political cooperation and formed extensive consensus,but lagging behind,some aspects of the legal system are increasingly unsuitable for the development of economic and trade cooperation between China and Russia.Therefore,to adjust and innovate the trade legal system between China and Russia is an important solution and a significant guarantee for promoting the China-Russia trade facilitation.It is the important focus to adjust and innovate the legal system of China-Russia economic and trade relations and promote the continuous improvement of trade facilitation between the two countries in developing the bilateral trade,and for its completion,great efforts must be made and many difficulties must be overcome.The establishment of a legal system to ensure the trade facilitation between China and Russia involves many issues and complex relations.It requires closer collaboration between the two countries to eliminate misunderstandings and reach consensus,so as to make remarkable achievements in the construction of the legal system to ensure China-Russia trade facilitation.To build a legal guarantee system for China-Russia trade facilitation,the consensus reached by the two countries must be further expanded and must be transformed into legal provisions,especially the key breakthroughs in strengthening legal cooperation between regions;the communication and interaction between the Chinese and Russian legal circles must be promoted,and the bilateral legal and cultural exchanges,cooperative legal personnel training,legal practice exchanges and cooperation,and the construction of legal dispute resolution mechanism must be deepened;a law-based path for cooperation in international economic and trade rules at the global,regional and national levels must be established to ensure the lasting development of China-Russia trade;the good environment between the two countries and within each country to implement relevant trade laws must be built to improve the efficiency of the implementation of laws;the trade laws between the two countries must be further sorted to build a more consistent and coordinated trade legal system,and establish the credibility and authority of the law.
