With the gross enrollment rate of higher education increasing from 17% in 2003 to51.6% in 2019,the higher education of China has officially entered the stage of popularization.The dominant role of university students' rights is more prominent,and their choice space become richer and broader.Higher education will also change from“seller's market” to “buyer's market”.University students will receive more and more attention,and the protection of their rights and the performance of their obligations have increasingly become the focus of attention.It is effectively urgent to standardize the management of university students to realize the adaptive development of talent training mechanism.It should examine the rights and obligations of university students from the perspective of ideological and political education,starting with structure analysis,and reflecting on outstanding problems such as talent training,internal governance and the improvement of higher education quality from the dimensions of “goal,content,level,motivation and guarantee”,are in line with the era background of the modernization of university governance system and governance ability,and also adhere to the indepth expansion of the important problems involved in the rights and obligations of university students from the theoretical and practical levels,which reflects the “problem-oriented consciousness” and the “solu-tion-oriented consciousness”.The rights and obligations of university students not only have their generality as ordinary citizens,but also have their particularity as university students.It is an interdependent,interactive and interactive system composed of many elements.The various forms within the university also determine the diversity of the rights and obligations of university students,which have a significant impact on the whole.This study attempts to put the rights and obligations of university students in the overall context of internal governance of universities,fully consider various important factors,carry out comprehensive analysis,and conduct systematic and structured research.In order to accept the complex reality of the optimization of the structure of university students' rights and obligations to give better play to the function of the system of university students' rights and obligations.Thus,universities should be promoted to manage education and schools according to law,effectively improving the efficiency of student management and service,promoting the modernization of their own governance ability and governance system,satisfying the needs of the increasingly rich personalized demands of students and promoting their free and all-round development.On the basis of inheriting the existing research results,the research is carried out according to the logical idea of clarifying the concept-tracing the history-should be description-actually analysis-solving problems”.Based on the cognition of the development process of university students' rights and obligations structure,the research aims to clarify its ideal state,actual state,and the optimization path.The path is what to optimize,why to optimize,how to optimize.Comprehensive use of text analysis,empirical research,comparative research,case analysis and other methods,according to the hierarchical relationship,select the goal,content,level,power and guarantee structure of university students' rights and obli-gations for analysis,strive to define and grasp the structure of university students' rights and obligations,grasp its existing problems and causes,and finally put forward the research goal of optimizing the path strategy of university students' rights and obligations structure.Firstly,this study clarifies the research results and deficiencies starting with the basic problems of the research on the rights and obligations of university students,from the perspective of explaining of the origin of the topic,through systematically combing the research status at home and abroad.Then,it expounds the ideas,methods and innovations of the research.Secondly,the study expounds the theoretical basis of the structure of university students' rights and obligations.First of all,it defines the relevant core concepts,and then discusses it based on the humanistic thought theory of Marx and Engels and combined with the relevant thoughts of the CPC's leaders,learning from the relevant theories of other disciplines,such as structural functionalism theory,so as to lay a solid theoretical foundation for the research on the structure of university students' rights and obligations.Thirdly,by means of combing the evolution process of university students' rights and obligations since the founding of new China,this study outlines the real picture of the generation and evolution of university students' rights and obligations in the period of socialist revolution and construction,the new period of reform and opening up and socialist modernization,and the new era,which objectively presents its development theory,absorbs useful experience.Fourthly,this study analyzes the structure of university students' rights and obligations,and grasps the overall appearance of university students' rights and obliga-tions.In view of the fact that the structure of university students' rights and obligations has been deeply integrated into the talent training process,it also covers the elements of education,such as goal formulation,content presentation,level division,driving factors and relevant guarantee.According to the role and relationship of each element,we adopt the method of logical deduction to select the goal,content,level,driving force and guarantee structure of university students' rights and obligations for analysis.Based on the higher education law,the regulations on the management of university students and the contents of the university constitution,combined with the characteristics of different types and levels of universities,and their situation in school running orientation,school governance,talent training objectives and modes,this study analyzes the natural picture of the target structure,content structure,hierarchical structure,dynamic structure and guarantee structure of university students' rights and obligations.Fifthly,the rights and obligations of university students have gradually grown and developed in the order space of mutual coupling of various powers inside and outside universities,and achieved many results,which are prominently reflected in accurate and scientific target positioning,increasingly rich and standardized content,etc.However,due to the imperfection of relevant legal norms,the constraints of traditional management thinking mode of universities,and the lack of attention to the personalized needs of university students in the new era,there are still many problems in the structure of university students' rights and obligations,such as lack of content characteristics,endogenous power and system guarantee and so on.This study mainly adopts the methods of text analysis and interview,combined with web crawler technology and “nvivo11.0” qualitative analysis software,in order to objectively and truly reflect the effectiveness and shortcomings of university students' rights and obligations structure,and analyze its causes with more pertinent,so as to provide optimization path for studying basis.Finally,under the background of the new era,the challenging factors brought by the changes of university students' characteristics,university governance structure and higher education environment provide directional guidance for exploring the path of optimizing the structure of university students' rights and obligations.Based on the reality of China's higher education development,we should actively explore more under the comprehensive leadership of the party.This study comprehensively considers the effectiveness and existing problems of the construction of university students' rights and obligations structure,combined with its specific causes,and considers from the dimensions of the subject,object,intermediary and ring of the optimization of university students' rights and obligations structure,and puts forward the following suggestions: condensing the joint efforts of multi-subject education.providing personalized and diversified education services,constructing the higher education laws and regulations system,and improving the internal governance and regulation design of universities,and strengthen the construction of the carrier for the protection of university students' rights and obligations.With new contents,new forms,new carriers and new ideas,we should deal with the new topics,new missions,new tasks and new requirements faced by the construction of university students' rights and obligations system in the new era,realize the benign interaction of different stakeholders,shape a good governance atmosphere,truly realize student-oriented and personally implement to foster character and civic virtue.To sum up,the research on the optimization of university students' rights and obligations structure has constructed a multi-layer analysis system from macro to micro,which is carried out in the system of university governance.Based on the in-tegration of multiple disciplines and guided by practice,it strives to build a theoretical and practical system integrating scientific,effectiveness and innovation Inherit tradition and integrate innovation.It will provide assistance for comprehensively promoting the administration of education according to law,modernizing the governance system and governance ability of universities,effectively promoting the all-round development of university students,and cultivating new people of the times who are responsible for national rejuvenation.
