| Since entering the new era,with the deep promotion of comprehensively and strictly administering the Party,as the Party rules and regulations system of “long-term and fundamental policy” to comprehensively and strictly administer the party,it has also entered the fast lane of development.The pace of the construction of Party rules and regulations is accelerating,the number of formulation and revision is increasing constantly,the quality is being improved,and the enforcement is consolidating.The construction of Party rules and regulations system is gradually becoming mature and falling into a pattern.To govern the Party,we must abide by the party’s rules;to set regulations,we must put stress on quality.The Party rules and regulations must have their own system,and implement them must be done actually.In July 9th,2019,General Secretary Xi Jinping delivered a speech at the central and state organs’ Work Conference on Party Building: “the formulation of system is very important,and the execution of system is more important.” We should not only have some accomplishments in establishing rules and regulations,but also pay more attention to the implementation and effectiveness,and have rules to follow.We should also strive to solve the problems of not following the rules even if the rules have been set,and not implementing them effectively.On September 3rd,2019,the Central Committee of the Communist Party of China printed and issued The Regulations on the Responsibility System for the Implementation of rules and Regulations within the Party of China(for Trial Implementation)(hereinafter referred to as The Regulations on the Responsibility System for Implementation).This is the first inner-party law formulated by our Party specifically for the implementation of rules and regulations within the Party,and has become an important milestone in the history of the construction of party rules and regulations.The promulgation of The Regulations on the Responsibility System for Implementation has solved the problems of “who will enforce the rules”,“how to distribute the responsibilities of enforcing the rules”,“how to enforce the rules” and“how to do without enforcing the rules” from the aspect of system.As an important link in the chain of Party rules and regulations construction,the implementation of Party rules and regulations is an important job to highlight the rigid constraints of Party rules and regulations.Therefore,it is extremely important and urgent to improve the executive power of rules and regulations within the party.The main line of this thesis is how to improve the enforcement of Party rules and regulations in the new era.On this main line,first of all,this thesis starts with the basic theory of the Party rules and regulations and the basic theory of the executive power of Party rules and regulations,and deeply excavates the elements of the executive power of the Party rules and regulations,which is the theoretical foundation of this thesis.Secondly,this thesis puts the executive power of Party rules and regulations in the perspective of comprehensively and strictly administering the Party,comprehensively governing the country according to law and promoting the modernization of national governance system and governance ability,and discusses the significance of improving the executive power of Party rules and regulations in the new era.Thirdly,this thesis comprehensively inspects the main achievements and experience of improving the executive power of Party rules and regulations in the new era from the positive side,and analyzes the main problems and reasons in the executive power of Party rules and regulations in the new era from the negative side.Finally,this thesis attempts to explore the effective path to promote the executive power of Party rules and regulations in the new era from the aspects of executing process,supervision,evaluation and guarantee conditions of Party rules and regulations.This thesis is mainly divided into three parts: introduction,body and conclusion.The body part is the main part,which consists of five chapters.The first chapter is mainly from the basic theory of the Party rules and regulations and the executive power of Party rules and regulations.Through the definition of the inner-party law enforcement,the five elements of the executive power of Party rules and regulations are excavated,which are the subjects,the objects,the resources,the environment and the monitoring of the executive power of Party rules and regulations.These five elements are not only mutually independent,but also mutually related,which together have an effect and impact on the executive power of Party rules and regulations.The second chapter focuses on the significance of improving the executive power of Party rules and regulations in the new era.From the perspective of comprehensively and strictly administering the party,the Party rules and regulations are the backbone of the “system” in the system of governance of the party,and the executive power of Party rules and regulations is an important guarantee for the comprehensively and strictly administering of the party;from the perspective of comprehensively governing the country according to law,the Party rules and regulations are an important part of the socialist legal system with Chinese characteristics,and the executive power of Party rules and regulations is the due meaning for the realization of comprehensively governing the country according to law;from the dimension of promoting the national governance system and the modernization of governance ability,the executive power of Party rules and regulations is embodied in the “governance of Party rules”,and the interconnection between the “governance of Party rules” and “governance of China” is the inevitable requirement of realizing the modernization of national governance.The third chapter focuses on the main achievements in improving the executive power of Party rules and regulations since the new era.For one thing,the system of Party rules and regulations has been basically formed,the horizontal “1 + 4” system has basically achieved the full coverage of party management and Party governance,and the vertical effectiveness hierarchy system has been refined layer by layer,which provides an important foundation for the executive power of Party rules and regulations;for another,the various elements in the executive power of Party rules and regulations have also made significant progress.In the new era,remarkable achievements have been made in the overall development of the executive power of Party rules and regulations.The fourth chapter mainly explores some problems existing in the executive power of Party rules and regulations in the new era through deep investigation,such as the system vacancy,system cutting,system perfunctory,system addition,etc.,analyzes the harm caused by these problems,and then analyzes the further causes of these problems from the various elements of the executive power of Party rules and regulations.The fifth chapter focuses on exploring the effective ways to enhance the executive power of Party rules and regulations in the new era,which is also the purpose and foothold of this thesis.From the construction of the executive power of Party rules and regulations,improving the supervision mechanism of the executive power of Party rules and regulations,completing the evaluation mechanism of the executive power of Party rules and regulations,optimizing the guarantee conditions of the executive power of Party rules and regulations and other aspects,this thesis explores the specific ideas to enhance the executive power.The vitality of the Party rules and regulations lies in the execution.The Fourth Plenary Session of the 19 th CPC Central Committee proposed that China’s national governance system and governance capacity are the concentrated embodiment of the socialist system with Chinese characteristics and its executive power,opening a new chapter of “China’s governance”.From “China’s system” to “China’s governance”,the integration of “system” and “governance” reflects the better transformation of China’s institutional advantages into national governance efficiency,and the process of better transformation is the process of enhancing executive power.As an important part of“China’s system”,the Party rules and regulations play an irreplaceable role in the process of realizing “China’s governance”,and the key to play this role is to continuously improve its executive power. |
