On The Legislation Of Water Resources-saving

We are entering a new time of water scarcity, and water will be the critical factor of restricting the sustainable development of the world in 21st century. So 21st century is regarded as water century. As the development of the economy and the expansion of the population, the contradiction between the need and supply of water is increasingly prominent in the world, and the water resources crisis has arrived in the world. So the problem about water-saving has been put forward on the agenda in every country. And each country has given priority to the reasonable exploitation and preservation of water. Our country is one of the water-scarcity countries in the respect of per capital water amount, and the situation is grimmer and grimmer of water-scarcity. The problem of water resources will seriously influence the sustainable development of our country. Even though, the legal system of water-saving has not been perfect yet. The phenomenon of water wasting and water polluting is very serious. So it is urgent for our country to establish a set of systematic legal system of water resources-saving. Thus the phenomenon can be ruled correctly according to that.Besides the introduction, the thesis is composed of the following five parts.The first part is about the general discussion on water resources, including the stipulation of the concept of water resources, the necessity and the urgency of saving water resources and the significance of legislation for water-saving. The present situation of our country's water resources is analyzed according to listing a series of relevant data. Based on that, a conclusion is made that it is of a great urgency for our country to save water resources. It is not only a prerequisite for the development of the national economy soundly and rapidly, but also an important condition for the improvement of our country in comprehensive national power and in international competition.In the second part, the theory bases of establishing the legal system for water resources-saving, including economics and law are explored. The theory bases of economics include resource scarcity theory, external diseconomy theory and economy man theory. The theory base of law is about law-value theory, and the environmental protection law is regarded as the important measure to realize the value of the legal system of water resources-saving.The third part is about the introduction and remark to the legal system of water resources-saving in foreign countries, including France, Israel, The United States and other countries whose achievements in this respect are great. Thus we can research their legal system and learn the advantages, and we hope it will be helpful for us.In the fourth part, the advantages and disadvantages have been analyzed of the legal system of water resources-saving in our country. The thesis points out that our present legal system has played an important role in making good use of water resources and saving water resources, however the legal system is not perfect.In the fifth part, based on the analysis mentioned above, some advice has been put forward in legislation for water resources-saving, including the perfection of the rules in relevant laws, the making of law of water-saving, the perfection of the system of water-users participation on management, the adoption of differential water prices, the high-price water recovery and so on. Thus we hope that these systems will help us to make good use of water resources, to establish water-saving society and resource-saving society.
