The purpose of this thesis mainly argues the regime design of packaging waste recycling system that is suitable to China's actual conditions, which is based on the existing recycling situation and compared with international advanced packaging waste regime. Nowadays, China has not established a genuinely industrialize and market-oriented packaging waste recycling system. Therefore, on the basis of a systematic analysis and research on the regimes and laws concerned of foreign packaging waste recycling system, the writer hopes that he can summarize a sound and international packaging waste recycling system by this thesis. This thesis will be analyzed and researched in four parts as follows:In part one: the thesis introduced the main characteristics of packaging waste and their types. Besides, it made a compartmentalization between solid waste and packaging waste and analyzed the dangers of the latter. Without a doubt, due to its specific characteristics, the packaging waste possesses both harmful and economic properties. In other words, if we recycle the packaging waste properly, we can obviously give play to its economic and ecological effectiveness. In order to better achieve these benefits, the writer holds that it is necessary to enact some packaging waste laws or regulations concerned.In part two: the writer chose a number of successful packaging waste recycling systems from different countries and comparatively analyzed them. Through the introduction of these countries'background when they implemented the packaging waste recycling systems, the writer analyzed the regimes of these systems. Furthermore, he concluded two recycling system on the ground of significance of market or government among these system mentioned above. The first one is government- oriented packaging waste recycling system, and the other one is market-oriented one. Likewise, the writer summed up the common and special characteristics of the two systems respectively, which can be used as a reference to us.In part three: This part majorly analyses the current situation of packaging waste recycling system in China. Because our packaging waste collection is mixed with other garbage, and this recycling system changed a lot from planned economy to market economic era. Similarly, the existing recycling system has developed from integrated governmental recycling way to a diversified form. Some executive bodies still shoulder the recycling responsibility, and many market subjects attend the new packaging waste recycling system. In addition, the thesis grouped the existing packaging waste management, and made a carefully delineation of the responsibilities on the executive branches, which will play a major role in the future establishment of the new packaging waste recycling system. In the end, this thesis simply introduced the main treatment of the current packaging waste and its state of development.In part four: Through the above analysis, the writer came to a conclusion that the most suitable packaging waste recycling system should be the market-oriented one. In this system, our country should give some market subjects some legal obligations on recovering packaging wastes by legislation. Besides, the laws aforesaid allow these market subjects to entrust their recycling responsibilities to third parties. Secondly, our government should initiate to establish a non-profit organization or company franchised, which will focus on managing integrated recycling of packaging wastes. Through this kind of institution, market subjects and executive branches conclude contracts with it to implement the specific packaging waste recycling works. As an independent market entity, the organization will cover the costs for the collection and recycling by fees that market subjects paid to it for using its green dot. Each packaging waste posted green dot will be free to be collected and recycled, which is separated from other garbage recycling system. Obviously, this regime will promote the enthusiasm of consumers to buy the products posted green dots, which will simultaneously stir more and more producers to join the new packaging waste recycling system.
