A Discussion On Legal System And Moralization In The Eco-environmental Construction In West China

The Great Development in West China is a significant strategy concerning the socialist modernized construction in China and the long-range existence and development of Ch. people. The great systems engineering is put into effect that will provide rare opportunity for Western to realize economic increase, on the other hand, it will bring about a great pressure on the fragile environment of West China. So, the first problem of the Great Development in West China is the trouble of environment and protecting and recovering the well environment must be a significant content of the Great Development in West China.This paper analyzed systematically the present conditions of the environment and the reasons which caused the ecocide in the West China. Then pointing out the great importance that we construct the west into protective screen of China. On the base of detailed analysis, this thesis pointed out the source of environmental trouble is two contradictions. One is the contradiction between human being and nature, The other is the contradiction among people concerning the first one. These contradictions are all important, moreover, the latter is the profound social factor of the former though its effect is not as direct as the former. So, how to deal with the relation between man and nature or the relevant relation among people has become the premise of working out and carrying out of the specific measures to protect environment. This demand us to insist on the environmental ethical view of sustainable development which believing people have to get along well with nature and showing the justice among people. Only guided by this view, enhancing the construction of environmental legal system and moralization, carrying them out all together, can we realize the environment turning for the better.This paper discussed systematically the thinking questions: the basic theory of legal and moral governing of western ecological environment, including its major content, achieving measures and the relation between them. At last it pointed out that the construction of western environment must under the guidance of the environment ethical view of sustainable development at present phase. Ruling by law assisted by the ruling by moralization, we can develop our self-discipline stimulated by external factors and construct the West China into an import ecological protective screen which insure the great development strategy in West China and the sustainable development strategy of China can be carried out safely, then the great national revival of Ch. people will come.
