| Patent protection has double effects on the accessibility of pharmaceuticals. On the one hand, reasonable patent protection guarantees patent holder's rights and boosts new drug research; on the other hand, the abuse of patent protection by the patent holder will result in monopoly and reduces the accessibility of pharmaceuticals. This paper examines the restriction effect of patent monopoly on the accessibility of pharmaceuticals, focuses on the positive effect and limitations of compulsory licensing and parallel import on the accessibility of pharmaceuticals. Base on the above research, the paper brings forward the countermeasures for China to take. First, apply the compulsory licensing and parallel import within the reasonable range; Second, enhance the development of generic drug industry; Third, develop Chinese own new drug; Fourth, carry out drug patent strategies. |
