Legislative Thought Of Consummate Domestic Environmental Administration System

The environment problem had become the major issue that affects the human Being's survival since 1970s. The economy of China has achieved a rapid growth since the establishment its policy of reformation and opening to the outside world nearly 30 years ago. However, the rough economic growth manner is based on the sacrifice of environment and the enormous waste of resources with an evil consequence of the deterioration of environment and the exhaustion of resources. With growing emphasis on the environmental problems and the survival crisis, domestic government entered on setting up special environmental administration institutions to take on the environmental administration responsibility. The particularity and the complexity of the problem cause intervention of the nation. According to the power enjoyed to administrate the environment, the state may adopt all kinds of measures to strengthen administration on activities of developing and utilizing the environment to protect and improve the environment. How to set up the institutions and how to deploy the power to administrate the environment as well as arrangement of the relations between the power and the social organizations and individuals have a influence on the running situation and efficiency of the environmental administration system. Such relationship is so-called environmental administration system which takes the core place in national environmental administration. Thus one scientific and rational environmental administrative system is a fundamental guarantee to improve environmental administrative efficiency.A leading role of the government has been emphasized in environmental protection in our country, which is characterized of administrative system. Under the trend of deepening the reform of system and keeping sustainable development of the society as well as espousing the problem of deteriorated environment problem day after day, the domestic environmental administration system now has behaved its disadvantage ineluctably. Hence, this article tries to carry on the analysis of our country present environment administration system through legislative thought and intend to give suggestions for consummating according to the reference of successful experiences in European Union, what for supplying several ideal in solving domestic environment problem.
