The Research Of Environmental Administrative Adjudication System

In modern harmonious society, environmental problems caused by many environmental disputes need to establish a sound, efficient environmental dispute resolution urgently. And environmental administrative adjudication, a new pattern of solving environmental disputes begins to take shape to meet the requirements of social development. Compared with civil lawsuit, environmental administrative adjudication has such advantages as simpler procedure, a lower cost and being conductive to the solution of environmental disputes which are more professional and technical. Therefore, the environmental administrative adjudication can meet the requirements of modern environmental administration. But, as this issue spread-eagle environment law and administrative law, the concern for it in the law circle is far from being enough and the theoretical study on the environmental administrative adjudication is not thorough to its fundamental research. In practice, China's environmental administrative adjudication system contraction falls behind other counties a lot. The application of environmental administrative adjudication power is largely out of control of the law. So the purpose of writing this thesis is due to deepen the theoretical understanding of the environmental administrative adjudication, find out the potential of executive power thoroughly in the environment dispute solution, inquire the administration and the judicature's road of fusion, and provide some personal advices on how to perfect China's environmental administrative adjudication system on this basis.This article's main research mentality bases on the Chinese native society, and pays great attention on the combination of theory and practice. Some research methods such as analysis, comparison and case study are used in the article. These methods make the proof have the persuasive power and the modernity. Through the research, the thesis constructed a complete system of China's environmental administrative adjudication theory, and it put forward some rational thought to perfect China's environmental administrative adjudication system. It is greatly expected that this thesis will be beneficial to the environmental administration legal construction of our country, especially the legalizing process of environmental administrative adjudication.
