The Study Of The Legal System About The Prevention And Control Of Ocean Engineering Pollution

Ocean environment has a direct bearing on the sustainable development of both environment and the mankind. But with the development of economy and society, the ocean engineering pollution forms increases along with it and the pollution is growing more and more serious , which brings about the environmental degradation.According to the situation, the Chinese government has worked out a sequence of laws, such as the" People's Republic of China Marine Environmental Protection Law"and "Regulations of the Prevention and Control of Pollution Damage to the Marine Environment from Construction Projects". But the report of Chinese Marine Environment quality in 2007 indicated that the areas which not meet the quality standards for clean sea water is about 145,000 square kilometers. One of the main reasons caused for the environmental degradation is the frequent ocean Projects.At present, the law field pays not much attention to the law of prevention against ocean engineering pollution. They have made some beneficial explorations, but there are still limitations in academic research's breadth and the depth, mainly appears as follows: less absorption of current international or oversea research results, not systemic theoretical analysis or specific system research in ocean engineering pollution…Therefore, this thesis is mainly to systematically summarize and research the law system to prevent ocean engineering pollution.This thesis will be divided into four parts. The first part gives the definition of ocean engineering pollution and the types of pollutants, followed it shows the hazards because of the ocean engineering pollution. The hard fact indicates that this is an enormous undertaking. The second part focuses on the definition of ocean engineering and position of the law for pollution and control. Ocean engineering of pollution control law is one of the China's legal systems to prevent the pollution of the marine environment and it is also one of the important components for preventing and controling the pollution of the marine environment. On the third section of this part mainly elaborates on the achievements made in the prevention and control of environmental pollution law for ocean engineering at home and abroad. Based on the study above, for the third part, the author mainly elaborates on the international and domestic law system. The basic system of our country ocean engineering pollution prevention law mainly includes: total pollutant control system, ocean environment influence evaluation system, ocean fee-levying system for pollution discharge and so on. The basic system of international ocean engineering pollution prevention includes precautionary system and international cooperation system. The fourth part is the most important part in this thesis. The shortages for the prevention and control of ocean engineering pollution, includes: unperfecting law system of assessment for the environmental effects, lack of right to know, bad co-operation for administrative system and so on. On the basis of summarizing the experience of international ocean engineering pollution prevention and control, the author provides new proposals as follows: establish the liability insurance systems of ocean engineering pollution responsibility, perfect the law enforcement by administrative authorities, the public participation and civil compensation, as well as developing environmental protection organization and strengthening international cooperation. These new suggestions will be helpful to strengthen and improve the law system of the prevention and control of pollution for ocean engineering, and rule the exploitation to reduce the pollutions and damages under the law.
