On The Legal Protection System Of Marine Wetland In China

Wetlands have been referred to as the "kidneys of the earth",and forest,ocean of the earth together constitute the three major ecosystems,with important ecological value,but with the rapid economic development,human damage of the wetlands increase,the number of wetlands reduce,as an important part of the marine wetlands,the situation is not optimistic. According to statistics,nearly four decades coastal areas due to the cumulative loss of coastal beach reclamation of wetland area of about 1.19 million hectares of urban and rural industrial land of about one million hectares,the two together for more than two million hectares, equivalent to the total area of coastal wetlands of 50%.Reclamation projects make an area of coastal wetlands reduce the speed of more than 20,000 hectares each year.China has 18,000 kilometers coastline,as a big country,the domestic marine wetlands directly related to marine wetlands in the world.In China there are no special wetlands laws,the protection of marine wetlands mainly rely on domestic resources,but because of the resources of the traditional over-emphasis on the marine legislation and the economic value of wetlands,marine ignored the ecological value of wetlands.Department to participate in the many marine wetlands and miscellaneous, the lack of co-ordination and departments have their own interests as a starting point,leading to decline in the efficiency of marine wetlands,creating wetlands in our country marine damage a large area,the ocean can not be optimistic about the status of wetlands in urgent need of marine specific legislation wetlands.In this paper,wetlands select special one category-marine wetlands as a focus of the study,combined with the relevant domestic and international theory and practice of marine wetlands through some of the basic concepts and theories,let us recognize the use of legal means to protect the marine wetlands important and marine wetlands for the legal protection system provides the necessary reference,this paper some aspects from the discussion:The first part defined the concept of marine wetlands,marine wetlands mainly refers to a low ebb when the water depth of 6 meters in coastal waters and wet areas,including water depth of not more than six meters of permanent water,the intervallic al zone(or flood zone) and coastal lowlands,and so on.As an important part of wetlands,marine wetlands have its unique features,including ecological functions,economic functions and social functions.In China,the existence of marine wetland function,the degradation of a serious and unreasonable exploitation of marine resources and wetlands in the status of lack of funds.The study of marine wetlands has great significance to the protection of the law.The second part used comparable methods,the United States and Australia introduced marine wetland protection legislation and policies.The United States legal system of wetland protection from federal,state and local governments,the effectiveness of three different laws and regulations constitute a wetland.Australia's wetland protection legislation is mainly embodied in the concept of "public participation".Finally through policy of the United States and Australia,this part discussed the policy of our country wetlands marine wetlands legislation.The third part primarily analyzed the legal status of marine wetland and pointed out our country the legal protection of the marine wetlands of the supplement,it should be clear of marine wetlands and scope of the concept,specifically the development of a "marine wetlands" in this law clearly the concept of marine wetlands and scope of application of the specific content,such as department director to make the relevant requirements.The fourth part focused on the legal protection of the marine wetland system,the theoretical basis,the value of some of the major foundation of law,foundation of ecological ethics,wetlands ecology and sustainable foundation for the analysis of the theoretical basis.The last part focused on marine wetland system to improve the protection of the law consider,through the Marine Wetland Reserve System,Marine Environmental Impact Assessment of Wetland Systems,Marine Environmental Monitoring System of Wetlands, Public Participation in Wetland and Marine Ecological Compensation System to improve.In this paper,methods of application of environmental ecology,comparative analysis, empirical research methods such as analysis of our country set up the legal protection of the marine system of wetlands in the need for an analysis.This paper presents the development of a special "marine wetlands law";a clear concept of marine wetlands and scope in order to protect specific;strengthen marine wetlands education;enhance awareness of public participation,the practice of public participation in the system;strengthening of the relevant department coordination mechanism between the administration in order to effectively solve the problem of marine wetlands.
