Legal Construction On Rural Habitat Environment Protection In China

From the time of China's reform and opening up, with the economic globalization pace accelerating, rapid agriculture development, many places of residence showed the extensive economic growth mode, resulted in a series of environmental problems, which affected the healthy development of the rural economy and society. These serious habitat environmental problems came mainly from rural solid waste, rural tourism, rural industries, agricultural fertilizer, pesticide considerable using, etc. Overall the country, environmental pollution is serious, ecology deterioration is clear, which leaded to many negative effects from the rural living environment. At this time, the state proposed the objectives and requirements of the new rural reconstruction. The new rural reconstruction also request the rural living environment and living conditions to become more clear, neat and good. However, from a long time, China's studies in the living environment have concentrated in urban areas, studies in rural living environment are little, and the system of research is littler.Based on above reasons, this paper analyzed the existing environmental problems and the reasons in rural areas, learned experiences from other countries and regions, and provided advices about improvements in technology and the integrity of legal system, the specific ideas are as follows:Chapter I is introduction section, clarify the whole issue from the background and significance, research methods and objectives. Chapter II elaborated the conception on China's new rural reconstruction and the rural living environment, and put forward the development goals of rural living environment. Chapterâ…¢summed up the main problems in the rural living settlements, analyzed the status of pollution, and hazards, learned experience from elsewhere and put forward to some technical measures to improve the living environment in rural areas. Chapter IV constructed the legal system of the rural living environment protection, in which included the farmers'environmental rights reinforcing, environmental protection law modification, the relative laws formulation and modification, environmental regulation integration, some environmental protection provisions of other departments in rural areas, and the relevant legal provisions in international treaties and international practices.
