Economic Loss Assessment Studies Of Environmental Pollution Accident

With China's economic,urban construction, and enterprises development,there is an increase in the risk of environmental pollution accident.The incidents caused by air pollution,water pollution,solid waste pollution,noise pollution,and electromagnetic radioactive pollution are gradually becoming the difficult problems in civil trial work.The main causes of the environmental pollution incidents are:①The identification of environmental pollution accidents and administrative handling systems are not perfect;②There haven't been professional assessment agencies;③in China the scope of environmental damage is narrower;④the scope of economic loss of environmental pollution accidents is unclear;⑤scientific and practical assessment of certification standards has not been established.For the reasons above, combined with the actual situation in Chongqing,this article focuses on the following aspects:①The article conducts a statistical analysis of pollution incidents in Chongqing from 2003 to 2008.②The basic content of environmental accidents are summarized as: the concept of environmental pollution accidents,its type,class,characteristic and general procedures for investigation and handling.③Based on"Constitution","Environmental Protection Law","Civil Law","Atmospheric Pollution Prevention Act","Water Pollution Prevention Law","Report of the Interim Measures of environmental pollution and damage accidents", and the other relevant laws,the thesis makes a study on the identification,reporting,emergency response procedures of environmental pollution accidents and disputes.④Based on the narrower definition of environmental pollution accident damage in China as well as the importance of environmental factors, in addition with the traditional personal,property damage indicators, the study increases the consideration of environmental factors,establishes indicators of economic losses,and defines the scope of environmental pollution accidents.⑤Guided by the principles of scientific,feasibility,the thesis screens initially and determines the personal loss,belongings loss, the appraisal expense of accident emergency, and the calculation method of the accident affection and the ecological environment lost,at the same time it carried on an match to indicator system's calculation method.⑥Due to the environmental damage assessment process in the United States, European Union as well as China's "Marine Oil Spill Technical Guidelines for ecological damage assessment",the thesis proposes damage assessment operation procedure by combining with the characteristics of pollution incidents.⑦Finally,the thesis makes a value calculation on economic loss in a major pollution accident happened in Chongqing.
