An Analysis Of The Legal Regulation Of The Third Party Governance Of Environmental Pollution In China

This winter, fog and haze occur frequently, became a national hot topic of most concern, worsening environmental pollution bring more challenges to the environmental protection system of our country. In view of this, in order to achieve efficient development of environmental pollution control through the reform of the existing pollution control mode, China began to boldly introduce the market mechanisms in the field of pollution control, and promote the third-party governance mode in environmental pollution control. But in this particular mode’s implement ation and promotion process, a series of problems and obstacles occurred, such as market access mechanism is not perfect, confused legal liability system makes the responsibility difficult to implement. For the above situation, this paper expands a study of environmental pollution from the Perfection of legal regulation of third-party control angle, hoping to promote the standardization and long-term development of environmental pollution’s third-party control.In this paper, the main content is divided into four parts, the first part focuses on the definition and comparison of environmental pollution third party governance’s concept with other similar concept connotation, and then this article analysis the necessity of legal regulation of third-party of environmental pollution control.The second part focuses on the issues in the field of environmental pollution’s third-party control. The third part describes the practical cases and advanced experiences of foreign third-party environmental pollution governance, and summarizes some of the recommendations and proposals which are suitable for China.The fourth part put forward a sound proposal for third-party control of environmental pollution through the development of the rule of law in front of the system analysis, mainly from the concept of legislation, as well as to establish and improve the coordination of legal system, to make relevant recommendations about legal liability system’s construction. This chapter also is where the difficulty and innovation of this article, especially the part in improving the legal liability system, this paper analyzes the current academic views about environmental pollution third-party control’s liability sharing mechanism of some of the major doctrines, which made me built my own recommendations about how to complete the legal liability system. All in all, the promotion of third-party governance in environmental pollution is imminent, although the view of this article there are many shortcomings, but also hope it can promote third-party management of environmental pollution continue toward the direction of the development of the rule of law.
