The Legislation Research On River Basin Management Of Our Country

River is not only the birthplace of human civilization, but also now a number of industrial areas, economic zones are built along the river,relying on the nourishment and nurturing of the river basin to be thrived. However, as people plundered and exploited the resources and environment of the river basin, many river basin ecosystems of the world are increasingly degraded, resource are exhausted, environment is polluted, it has become the bottleneck of the sustainable development of human social and economic. In recent decades, the domestic and international river basin management has made considerable progress and plays a huge role in promoting the development and protection of river basin's environmental resources. Integrated management of water resources by river basin has been proved to be an effective approach by the practice of watershed management. In 1968, the European Parliament passed the "European Water Charter", it proposed that water resource management should be based on the natural watershed, and should not be based on the administrative areas, watershed basin is supposed to establish the appropriate institutions. The world 102 heads of State or Government adopted and signed the "Agenda 21"at the United Nations Conference on Environment and Development which is held in Rio de Janeiro of Brazil in 1992. The"Agenda 21" requires the unified management of the water resources in accordance with the river basin, which is a comprehensive exposition of objectives and tasks of the river basin water management. Of watershed integrated management of water resources has been accepted by most of the world, becoming internationally recognized scientific principles. The first part of the topics explains the involved concepts; the second part is a brief analysis of river basin management system in our country, first of all it is our current watershed management system and management model, and then I try to find out the deficiencies of the existing management system, which includes the problem of watershed management structure , not setting up mechanisms to cope with and existing legislation, to find ways to solve these problems in the following discussion; the third part is the thinking of watershed management system's innovation and legalization ,which is largely based on advanced management system and the mode of the system abroad to promote innovation in China, then it needs to learn from foreign legislative experience, at last I attempt to summarize the successful legislation experiences which we can learn from of the watershed management ; the fourth part is the legislation construction on watershed management in China, it proposes legislation on how to build China's watershed management system based on the analysis of previous chapters. After the analysis of several development modes of the watershed management agency, we first need to establish integrated river basin management, including the integrated watershed management agencies to set up and run; followed by the construction of watershed management legislative system, including perfecting the existing watershed management-related law, drawing up the special watershed management law, supporting laws and regulations related to the formulation; finally we need to establish the legal system, including public participation in the system, ecological compensation mechanism and information disclosure and notification system and so on.
