The Legal Issues Of "Distinct Property" In Innovation Of Collective Forest Ownership System

Forestry is an important project in relationship with the rural development and people's livelihood. In recent decades, innovation of forest ownership system in China has been engaged in various attempts. Since 2003, China started a comprehensive innovation of collective forest ownership system, the range of the influence gradually expanded from a few pilot areas throughout the country. Because of the lag of forestry legislation, the current legal system of forestry can not conform to the innovation of collective forest ownership system, the conflict between them led to a series of practical issues.This article is divided into five main parts. The first part is an introduction, introducing the purpose, background and methods of the research, and current status of the forestry legislation. The second part is the basic concept, systematically expounding the concept, characteristics and nature of the forest ownership, and the concept, meaning, substance and form of the property rights. The third part is the legal issues in process of property rights, analyzed from two aspects which the interface between law and law, and the interface between law and forestry reform. The fourth part put forward some recommendations for improvement from two aspects which the relation between law and law, and the relation between law and forestry reform. The fifth part is the conclusion. This article aims to card and analyze the legal issues in the reform process of collective forest rights, and put forward some targeted recommendations.
