The Combination Between The Social Life And Courtesy And Law In Han Dynasty

After the unification of six nations, Qin dynasty founded a dynasty with great unification.But after fifteen years, the peasantry uprising ruined the great unification. How to maintain anever-lasting peace was becoming what Han dynasty faced with.Before Han dynasty, China had experienced two kinds of social rules, namely, courtesy(existing in Zhou dynasty) and law (existing in Qin dynasty). However, these two kinds ofrules fell short of social needs in Han dynasty. Therefore, to establish a new rule was tobecome the urgent thing that Han dynasty must deal with. The paper consists of three parts. 1. To try to open out the consistency between courtesy and law in themselves by meansof the description of the origin of them. 2. To analyze the changes in the rulers' thought after the foundation of Han dynasty. Onthe one hand, the rulers kept insisting on the domination of law which was inherited from Qindynasty; on the other hand, they respected Confucianism and advocated moral domination.The purpose of that is to prove the inevitability of the combination between courtesy and lawin Han dynasty. It is politically embodied by all kinds of dominant strategies and lawcontaining courtesy in juristic institutions. 3. To demonstrate that the dynasties after Han dynasty put emphasis on the fame andrelatives, which was the social vogue at that time through the analysis of the combinationbetween courtesy and law and the description of social changes in Han dynasty According to the historical materialism of Marx, after the careful examination of theoriginal materials and other basic materials, the paper uses historical study method as well asmethods in sociology and folklore to systematically reveal the true situation of thecombination of courtesy and law in Han dynasty from different aspects.
