After World War II, the ocean order of world has ever sunk into the confusion appearance because of the promotion of ocean strategy position and the fighting of many countries to obtain the ocean resources. For sake of making sure the law system of different waters and adjusted the rights and duties of developing the ocean resources, United Nations continued to convoke two conferences on the Law of the Sea, and regarded resolving the breadth of the territorial sea problem as the main content. However, because of ocean benefits clash among all the countries which attended to the conferences, the two United Nations Conferences on the Law of the Sea had no results to discuss the breadth of the territorial sea problem. At that period, the ocean policy of United States is maintaining "the freedom of the seas", in order to control the wealth of the seas, control world wealth, from but control the world. This policy principle which has been continuing until now, was also an important factor to make the United States not yet joined the United Nations Law of the Sea Treaty up to now. At the same time, it also produced the profound influences to the other nations in the world.By exploring the policy of United States of the breadth of the territorial sea problem in this period, reappearing the policy of the breadth of the territorial sea in tenures of President Eisenhower and President Kennedy, combining the Declassified Documents Reference System and related new file data with network resources, making use of the history, the international relationship and jurisprudence to analyze establishment principle, process and its influence factors of the policy of the Law of the Sea inside the breadth of the territorial sea problem in tenures of President Eisenhower and President Kennedy, looking for the reason why the United States not yet join the United Nations Law of the Sea Treaty until now.
