On Transmutation Of Farmer's Rights Since The Foundation Of PRC

Discussed in this paper is the transmutation of farmer' srights since the foundation of PRC. The issue of farmer' srights actually is what we called Three F Issue for a long time.Since the foundation of PRC, as the main force of revolutionof Chinese Communist Party, politically farmers became mastersof the new country, but their own problem still existed becauseduality social structure of separation of urban and rural areaswas established in a united sovereignty. Since reform andopening-up, farmer' s political rights, economic rights aswell as social rights were severely damaged. This is anundoubted fact. Farmer's political rights refer to the rightsthat farmers participate in and influence political life soas to satisfy their needs in political field. In the country,farmers just have the right of electing and being elected andsuperintendence and right to know of village administrationand management. However, in the political life of the wholecountry, farmers do not enjoy real political democratic rights.Farmer' s economic rights mean the rights related to economicactivities or economic benefits and protected by theConstitution. Nowadays, farmers have very few social rights,especially farmer' s social security right, socialparticipation right, right of being educated, right ofparticipating in and organizing farmer's association,environmental right. The realization of farmer's rights isrelated to the realization of target of establishing socialismnew country. The protection of farmer' s right concernsconstruction of socialism democracy, construction of nomocracy society, development and amelioration of socializemarket economy, realization socialism target of well-offsociety and whether harmonious society could be built.Therefore, the study of this paper is not only of strongtheoretical significance, but also of important practicalsignificance.This paper starts with the basic concepts of farmer' s right,analyzes the transmutation of farmer' s rights since thefoundation of PRC, demonstrates the changing from theviewpoint of history, sociology and law, discusses thedevelopment and the reason and principle of transmutation offarmer's rights since the foundation of PRC on the basis ofhistory and historical material. Finally, this paper raisesrelevant suggestions to the loss of farmer' s rights.
