As WTO is coming to China, the integration of Chinese agriculture into the global economy is speeding up. Rural land legislation and system construction have been a very important part of current reform. Since the reform and open to the outside world, Chinese government has issued many rural land laws and policies, which have solved many actual problems. However, as the rural reform enters a bottle-neck period and is slowing down, and and laws?and the related system have not been entirely set up and prefect, the rural market has not been explored, and rural land economy is still considerably apart from the objective of modernization in system and actual operation, the influence of traditional rural land legislation and system reform on the present can not be underestimated.. In the paper, the author analyzes Shangyang Reform and Wang Anshi Reform, the most typical examples in Chinese traditional land system reform. With respect to the former, the research is concerned with the social background, land legislation and related system construction, and also the cause of his success. With respect of the latter, the cause of the failure in land financialization from the viewpoint of influence of system reform on the classes of the society, trying to clarify that it is the success of peasantry mode and the failure of commercial agriculture that hold back the development of afterward modernization in Chinese rural area. At the same time, the scope is broadened to the two oceanic countries the United Kingdom and Japan. Their transformation processes from feudalistic to capitalistic society are investigated. The main point lays in that integration and mutual inspiration of land legislation and corresponding system construction made the easy transformation to modernization. For clarifying the influence of Chinese traditional land system reform on the society, and the cause of their difference with the United Kingdom and Japan, the author sets up a multidimensional analytical structure based on the positive paradigm of Durkneim, Historical Sociology of Wcbex; Structural Sociology of Marx and the theory of Geography Environment of Hegel. The land system is then put in the structure, and the Chinese land legislation and system reform are discussed from the interaction of the regional economic structure, social system and cultural thought. The cultural and economical framework of traditional land legislation is sketched by comparing and analyzing the traditional rural land legislation and system construction home and abroad, which could be beneficial to the rational judgment to land system and its modernization. Finally the author argues that for the modernization of the land legislation and system reform in nowadays, we must reform the peasantry economy mode, adjust the ownership functions, reform the taxation system, establish the public finance system, change the peasants?attachment relation to the land and improve the other corresponding system. From the analysis and investigation of traditional rural land legislation and system construction we come to the conclusion that historical condition and convention are very important factors. The accumulation of various resources, inheritance and change of tradition must be a relatively natural and progressive process, as is also the case of the modernization of rural land legislation and system construction.
