On The Strategy Of The Punishment Of The Organized Crime At The Early Stage Following The Founding Of The PRC

With the deepening of reform and opening to the outside world,organized crime, which had ever been stamped out of the mainland ofChina for almost half a century, has revived like dying embersglowing again. Moreover, it is evolving in expanding and enlargingtendency. It has brought about serious harm and menace to our publicsecurity. Therefore, 97'criminal law added relevant provisions oforganization in the nature of criminal syndicate. How to effectivelypunish and prevent organized crime becomes an urgent and arduoustask, meantime, which is also research problem with greatsignificance in the field of criminology. As a result, the authorattempts to probe into the "case" of how to root out the organizedcrime at the early stage following the founding of the People'sRepublic of China mainly from the perspective of relationshipbetween state and society, looks back upon the historical practice ofthe period.This paper discusses the strategy of punishment of the organizedcrime at the early stage following the founding of the PRC mainlytiom four parts, namely, the organized crime's forms and features, thehistorical perspective of the organized crime's forms, the strategiesand validity of the organized crime's punishment, the evaluation andenlightenment of the organized crime's punishment. The paper,against the historical background of the relationship between state andsociety in three periods, namely, the early stage of Qing Dynasty, themodern period, the early stage following founding of the PRC, on thebasis of summing up the punished strategies, analyzes the reasons thatthose strategies could be effective, provides the enlightments of howto punish and prevent the contemporary organized crime as possibleas I could actually.
