After having negotiated 14 years, we have already approached the World Trade Organization (WTO). At present, the negotiating are getting along au right. Entering WTO will impact our society, economy, culture and intellectual property.Since eighties age especial nineties age, the world development has put up two different characteristic: economic globalization, technology quickly developing. This position has effected patent system of its status and action in the world. This mostly materialize three aspects: (1) Patent status are getting increasingly important in economic living and truck in the world. (2)Duo to the protection of patent and others intellectual property, technology has become important power and factor in economic increasing (3) Base on the motioned above, Many nations, special developed countries in science and technology make intellectual property competition important tool and means in market competition and economic competition. So" Agreement on Trade-Related aspects of intellectual Property rights"(TRIPS) has come into being. It is the one of the most important intellectual property agreement so far. It will bring great infection to our reform and opening. This kind of infection request our law keep consistent with TRIPS.Most importantly, our patent system need protection power, procedure need optimization and state enterprises enthusiasm need mobi Iize. Base on the above motioned need, Our country has come out with the patent revised in August, 25,2000. This is the second perfection to patent law. The perfect ion has made great progress, but patent law still need consummate and enhance. According to the comparative study on TRIPS and our patent system, this article has brought forward some ideas to perfect patent law.
