Research On Legal Problems Of Disposing Crisis In Financial Institution

With the further reform on financial system and the further consummation of market economy rules, the competition among financial institutions becomes more and more fierce and the risk of finance increases accordingly. The keen competition inevitably results in eliminating the inferior, among which some superiors expand while the inferiors meet with crisis Meanwhile, as a special industry with high risk, finance is different from ordinary enterprises. In case of any crisis in a financial institution, it is likely to cause financial storm and endanger the stability of the whole society without cautious disposal. At present stage, due to the imperfection of the law of disposing the crisis in financial institutions, it is an essential task to study how to deal with crisis properly as the last line of defense in financial supervision and management of the central bank.On the basis of analyzing China's present situation of legislation in this field, and studying the successful experience of disposing crisis abroad, the author discusses how to deal with crisis in financial institution and proposes some constructive suggestions and advice on the interrelated legislation in China.
