The Research On Some Problems Of China Joining The WTO And Perfecting The Competitive Legal System

In order to meet the demands of China joining the WTO, it is an important and urgent task to formulate and establish the suitable legal system. The various existing improper competitive actions have hindered the healthy economic development and a lot of natural monopoly department of the monopoly departments o\vned by the country have infringed the legal interests of consumers by using their dominant position. However the cases of monopolizing the market by the transnational corporations may also often appear after China joining the WTO. So it is very urgent to establish the market order for fair competition and formulate and perfect the law of competition. Although China has issued the law of anti-unfair competition, there is still lack of comprehensive anti-monopoly legal system and the system for enforcing laws. It is the important subject at present to formulate and perfect the law of competition by using the successful experience of the developed and developing countries for reference.This thesis points out the direction and task for perfecting economic legal system construction and also the key in fomiulation and perfecting the law of competition through analyzing the influence on economic legal system construction in China for joining the WTO. As introducing the concept and the basic rules of the law of competition, the author mainly studies the functions and usage of the law of competition. The aim to set forth the basic frames and contents and developing trend of the western developed and developing countries is to use their experience for reference to formulating the law of competition in China. Having reviewed the course of setting up competitive legal system and concluded in general the characteristics and shortcomings of the present competitive legal system and analyzed the cause of improper competitive and monopoly actions and mainly studied the perfect of the anti-monopoly legislation and anti-unfair competitive law, the author puts forward the necessity and urgency for formulating and perfecting the law of competition. The author puts forward his tentative idea and concrete implementing suggestions forperfecting the organizations and level of enforcing the law after further studying the aimof legislation of competitive legal system and the mode of legislation according to China's national conditions. These ideas and suggestions depend on the knowledge and discussion of the problems discussed above. They are also the author's focal consideration in his research of economic policies for years. The author wants to make his contribution to formulation and perfecting competitive legal system and setting up the fair competitive market order through the exposition of his thesis.
