Tactics Choice For Anti-dumping Against China

Anti-dumping ,being a focus problem in international trade since two decades ago ,can be attributed to the effects that achieved by eight successive rounds of GATT multilateral negotiation that traditional trade barriers have been greatly weakened .For example ,tariffs have been cut down and non-tariff barriers such as quotas and licenses have been reduced .At the same time ,a new suit of legal trade tools permitted by GATT/WTO such as anti-dumping .anti-subsidy and safeguard measures emerge as the time require .Despite the different opinions about anti-dumping in economy theory bounds ,trade bounds and law bounds .nowadays ,to many countries especially the western countries ,anti-dumping has become one of the most important means to restrain unfair trade and protect domestic industries .Since the founding of WTO ,1995 ,every member of WTO has established ,amended and perfected their own anti-dumping ,measures one after another according to WTO agreement on anti-dumping .Anti-dumping has become an essential part of the trade policy and law in every country .Chinese foreign trade has gained large achievements during the past fifty years .and has developed rapidly particularly in the past 20 years since the reformation and opening .The amount of Chinese foreign trade has broken through US$ 470 billion .and by the end of 2001,China has risen to No.7 among the greatest export countries .Furthermore ,our export amount is still increasing .However ,frequent anti-dumping investigation in Chinese products by many countries ^specially western developed countries ,has been the serious obstacles to the enlarging of our export .What does this come into being ?The reason lies not only in the discriminations against China for not being a member of WTO ,but also in that Chinese export enterprises competed without order and our export products lacked of competition .Since January 1,2002,China stared to carry out the promises of WTO in due form ,so the international environment of our foreign trade has undergone great changes .Could we avoid the increasing anti-dumping after we have joined the WTO ?The answer is 'NO' .Anti-dumping ,as a trade measure permitted by WTO will remain for a long time .and after China joining WTO .other nations and regions will rely much more on anti-dumping and anti-subsidy to beat Chinese products so as to protect their domestic industries .It's necessary to discuss how to defend and respond to anti-dumping against China under the new situation .In the first part this article explains the definitions of dumping and anti- dumping . One point that should be put more emphasis on is that anti- dumping itself is not bond to damage to domestic industries .So it is necessary to prove there being consequence between dumping and damage before imposing anti-dumping duty. The second part ofthis article analyses the game tactics of the prosecutor and the defendant ;and the cost-income decision-making under P-W-D pattern .The third part remarks on the discriminations against China ,and on whether China might avoid increasing anti-dumping after joining WTO .And at last it draws the conclusion :the anti-dumping environment will deteriorate worse and worse in the whole world ,so discussing and applying the countermeasures of anti-dumping comes to be an unavoidable task for the export products and enterprises .At last ,the article is directed at bringing forward the tactics choices of how to defend and respond to anti-dumping against China .
