Institutional Crime Phesis

Institutional crimes have been of long duratiors,especially after the second World War,the crime has been developing rapidly all over the world. However, whether legal persons can be the subject of the imlitutionel crime has been the point at issue for fears. By researching on the origion, determination, criminal liability and improvement of imtitutional crimes, this article analyses and compares in detail some hot issues concerning the institutional crime with the combination of legislation theory and practice at home and abroad. It gives answers to that legal persons can be the subject of crime. In addition,it analyses thorougly with a clear aim the following, knotty issues: State agencies and private enterprises as subjects of crime and their merger, split, changing names and systems, bankruptcy, dissolution, cancellation, suspending operations and switching to other products after committing crimes. Institutional crimes In the field of environmental pollution and computer engineering are even looked into deeply. Finally, this article appraises the imtitutional criminal liability system in China's legislation. Accordingly, it puts forward the concept of how to improve the system concretly, and, in particular, some legislation advice as follows: kinds of punishments such as adding and improving the criminal bankruptcy, crimrnal fine, punishment against qualification and setting up the non-criminal system of the institutional crime, which is of great importance and value for the criminal judicature and legislation of institutional crimes in China.
