The Theory And The Applicaion About"Parole Regulation"

Parole,which is the altered system of criminal punishment,is generally applied around the world. In theory,our country should define Parole as one of the criminals' right,which can be regard as the proper balance between defending our society and guaranteeing the criminals' right. Because "Parole Regulation" suits the theory of educating and remodeling the criminal,and reflects the economic principle of Criminal Punishment,and reflects the individual trend and social trend about Criminal Punishment;in application,to re-educate themselves and to remodel themselves,which is the motivating function of "parole regulation";and "parole regulation" still has two other functions,that is,the altering function of applying criminal punishment and the helping function for the criminals to return to the society in future . Comparing with different countries' "Parole Regulations" in setting up criminal laws and applying criminal law,and according to our own country's applying "Parole Regulation",We can find out that our country's "Parole Regulation" is under-applicable and inefficient and is lacking sufficient after-supervising,So we can better the "Parole regulation" in three sides,that is,setting up new Criminal punishment theory,and building up the applying system of "Parole Regulation" and the after-supervising system of "Parole Regulation",in order that our country's "Parole Regulation" can be efficiently applied.
