The author makes a comparative analysis of the provisions of the PRC Maritime Coderegulating the liability of the carrier for the death of or personal injury to a passengerand the corresponding solutions of foreign laws and international conventions. Sheseeks to establish to what degree the solutions of international conventions have beenincorporated into the PRC Maritime Code and predict to what degree the amendmentof Athens convention will impact the domestic law.At the international level the carrier's liability has been stated by the 1974 AthensConvention relating to the Carriage of Passengers and their Luggage by Sea (AthensConvention). The Athens Convention was attached to the 1976 Protocol and the 1990Protocol.International Conference was hosted by CMI in Singapore in 2000, where aconsolidated text of Athens convention and prospective protocol was submitted toLegal Committee. Adopting the new system of carrier liability inclusive ofenhancement of limitation amount, compulsory insurance and the third party's right tosue directly made the most significant progresses.The dissertation consists of such issues as summary of international carriage ofpassenger,scope of liability, limitation amount, compulsory limitation insurance andsoon.The author's concentration on International carrier liability system is aiming to help toestablish the new legal system in this field to which little attention has been paid.
