Research On Legal Issues Regarding Measures Of The Security Of Cargo And Liable Subjects

As the acceleration of the process of the unification of global economy, international maritime disputes, whose cases kept growing in the past few years, have displayed a trend that in such disputes the interlacing of relationships between sea shipping and cargo trading has become more and more complicated. In order to have all parties' rights and responsibilities well coordinated and balanced, more attention has been given to the legislation of security of maritime claim in cargo in many countries. Thus bringing an important task for our research. This dissertation would be focusing on the liable subjects, deploying a thorough, in-depth study on the security of cargos in maritime transportation using a integrated, comparative methodology.At the very beginning of this dissertation, a detailed, multi-angled and layered expatiation on the litigation/arbitration and the subject/object/content/elements of the detention of cargo, based on an investigation of the type and legal characters of the security of cargo. Next, a full-scaled analysis on the liable subject, who may take measures on the security of cargo but usually encounter considerable disputes in actual process, would be carried out. Through above contents, a comparative analysis on the legal effectiveness is achieved which substantializes a possible solution to the conflict on the actual practice of detention rights between administration body and judicial body which both entitled to such rights.And finally, some practical, operable suggestions are made to the enrichment and consummation of the legal systems regarding the security of maritime cargo, with emphasizing the significance of a complete version of such legal systems to the country's maritime law and even the whole shipping industry.
