Countermeasure Analysis And The Reform Of Chinese Judicial System Under The Influence Of The Regulation Of WTO

The World Trade Organization (WTO) is a multilateral economic and trade Drganization which is the biggest and weightiest one in the world. By accessing WTO, the economy can be more international and the development and modernization will be advanced greatly in China. It is important to improve the rules and bring a better, more reliable and fair legal environment to international and domestic enterprises according to rules of WTO and the legal system of China socialist market economy. From the same point of view, the dissertation studies on the issues concerning policy analysis and the reform of Chinese judicial system under the influence of WTO and hope to make some exploratory research with regard to the subject.One chapter of the dissertation has been used to introduce the background, characters and main institutional influences of WTO. Whereafter, the dissertation studies on the general force and direct force to internal laws of the parties of WTO. Arguments and analyses are also provided with respect to the judicial examination system of China under the influence of WTO. The main idea of the dissertation is derived subsequently, which is that a judicial system suitable to the institution of WTO should be built in China, rhe suggestions is thrown out in the forth and fifth Chapter mainly regarding to the two aspects concerning the influences on the China civil judicial system and the people's courts by WTO. For example, some suggestions are submitted with regard to the reforms of judicial system, the system of judge and justice according to the influence on the independent judgement of the people's court by WTO.Finally, It is pointed by the dissertation that it is significant to study the rules of WTO and the improvement of China judicial system, and the most important is to build a judicial system in China that is suitable to the system of rules of WTO.
