The modernistic factors of the judicial system include judicial independence, judicial unitarily, judge's professionalism and nationalization of judicature etc. By reason of traditions, ideas and the systems, modern judicial system in China bring about dissimulations, such as localization of judicial power, administration of judicature, popularization of judicial profession and enterprise of judicature. In order that judicial power function smoothly, China must carry through institutionary innovations based on the native resources and we must reform the systems which lead to administration of judicature, remove localization of judicial power, overcome the popularization of judicial profession and eliminate the enterprise of judicature.
