The Research On The Protest Power, Public Convincing Power Of Personal Property Mortgage Register And Acquisition Of Personal Property With Good Intention System And The Relation Between Them

Personal property mortgage register system and acquisition of personal property with good intention system have been put into practice throughout the world and proved efficient. And the acquisition of personal property with good intention system is especially common in the continental law countries. But at the same time, owing to these two systems' instinctive characteristic and its breakthrough of the traditional law, it brought a series of new problems.This thesis based on the premise that our country's law should adopt written form as legal form, which also called protest principle, and on specific analysis of law constituent, combined with the experience learned from legislation case and theory home and abroad. I started this thesis with the origin of the acquisition of personal property with good intention system, trying to make a research on the protest power, public convincing power of the register, and acquisition of personal property with good intention system and the relation between them according to some comparison and analysis. This thesis also put up some suggestion about how to improve our country's law and theory study, which I hope will do tatter for the development and improvement of our country's legislation.
