On The Improvement Of Legal Regime Of Possessory Lien On Vessel In Chinese Law

Possessory lien on vessel is an important legal regime in maritime law and may effectively protect the rights of creditor. The definition of possessory lien on vessel contained in Art. 25 of China Maritime Code make the legal regime of possessory liens on vessel obscure.In order to improve the legal regime of possessory lien on vessel in Chinese law, this thesis sets forth the complete concept of possessory lien on vessel and classify it. Through analyzing the relation between possessory lien on vessel and possession of vessel, this thesis illustrates the concept, loss, reversion of possession of vessel. The thesis makes it clear that a maritime lien on vessel shall have priority over possessory lien on vessel and possessory lien on vessel shall have priority over a ship mortgage. Also the thesis analyses the realization of possessory lien on vessel. Finally, aiming at solving the problems concerning possessory lien on vessel in Chinese law, the writer puts forward a series of suggestions.
