The Research For The Theory And Method Of Construction Claim

Along with entering into WTO, our national building market will gradually enter into international building market, thus the function and significance of construction claim are becoming obvious and prominent. In order to study how to correctly recognize and justly treat Construction Claim in situation of our country, to help engineers and lawyers to rationally analyze and rapidly sovle Construction Claim, and to provide support of theory and analysis means, this thesis discusses some things from the side of constructor under FIDIC conditions of contract. At first, the concept and properties, the characteristics and impersonal existense of construction claim are stated in this paper, and claims are classified systematically from different point of view. Next, the scope, principles and procedures of construction claim are formulated in the thesis. This thesis mainly analyses the claim for extension of time and financial claims. Through collecting a good deal of relational material, the thesis puts forword analysis methods and calculation models of the two sorts of claim . In analysis methods of the claims for extension of time, the thesis puts forward The Time Impact Analysis (TIA), it is a delay evaluation technique with the basis of the chronological summarization of delay events, the treatment of overlapped events, liability apportionment of concurrent delay and allocation of Total Float Time . In analysis methods of financial claims, various cost items are analyzed in detail on incur causes, liability proportion and estimation, specially, writer introduced his own principles and methods of calculation and puts forward new calculation formulates. In the thesis, pilot study and development of the computer promgrara for the delay claim analysis are conducted, this program can be used in analysis and evaluation of construction delay claim in engineering practice.
