Studies Based On Contractor’s Construction Claims Theory And Application

This paper has investigated deeply on construction claim from the perspective ofcontractors. Based on the theory, the concepts and origins of construction claim, evidence forlodging claim and claim skills has been discussed. Through the systematic theories andcombining with the successful lodging claim cases, our country’s experience and defect of theclaim application has been drawed. The value of the paper is that, by combining theory withpractice, improving contractors’ knowledge of the claim application, and giving a referencefor the inevitable construction claims in the project.To guarantee our builders to gain economic benefits to the maximum extent throughoutthe performance of the construction contract, the study of project claim management researchis very necessary. But the real problem is--we often fail in discovering and seizing theopportunity to claim, and even in collecting and reorganizing data and materials relevant toclaims, that results in few successful project claims cases. I hope the analysis of the claimapplication could urge project manager to firmly seize the opportunity of project claims. Withhigh degree of responsibilities and precise working attitude, on the bases of fully research ofbidding documents, construction drawings, design documents, technical specifications,contract agreements signed by supervision engineers, owners and contractors, transactionsdocuments and related laws and regulations, they can follow strictly all the procedure tobegin the claim work according to the contract, with evidence, good reputation and skills, toachieve the maximize benefits of the project.
