On China's Current Administration Ethics Construction By Rule Of Law

Nowadays, our country is during the particular history period of accelerating the reform, further opening to the world, transforming the economic and social system. For the administration system, government agency should assure the administration management to nation and social public business is on the foundation of rule of law, effectively control the administration behavior. The moral principles are the contents of administration ethics that should be followed in administration management activity by administration organization and its public officials, however the rule factors of law, system, etc are the ethics construction and form of administration. The form of the administration ethics must unify with the contents so as to effectively develop the function that adjust administration behavior. So it is necessary to enhance our administration ethics of the socialism in the realm of the public administration and propel our administration ethics construction by rule of law. Also it is important to put up the research of administration ethics.With a thought stream of 'raising problems, analyzing problems, solving problems', this thesis can be divided into five parts, including explaining theories, necessity analysis, blemish and reason analysis, history experiences analysis and contemporary construction. The thesis always lays emphasis on what is administration ethics construction by rule of law, why and how to construct administration ethics by rule of law.The first part explains some relevant theories of the administration ethics construction by rule of law. It accounts for the dialectical relation and harmonious function between the morals and the laws. It distinguishes the limitation of constructing administration ethics only through legal rule or system. At the same time it affirms the essentiality of the system of law. On this basis this part explains some relevant conceptions that are important for the following study. Then this part exposes meaning of the administration ethics construction by rule of law, consisting of moral legalization in administration and morality hi administration legal system.The second part analyzes the necessity of administration ethics construction byrule of law from two main lines-history retrospect and contemporary angle ofview, and four aspects-history experience, transforming society, new theory ofpublic administration and political civilization in socialism.The third part returns to the actuality of administration ethics construction by rule of law in China, pointing out among them the key problem that exists is: the moral legalization is weakening in administration and morality is lack in administration legal system. Immediately it explores the reason of the blemish from three ways including traditional administration culture, unilateral cognition in human nature and the regulation of morals growing in order to further demonstrate the necessity of administration ethics by rule of law, using the method of the substantial evidence analysis.The fourth part retrospects the development of administration morals law in the ancient Chinese, the development origin and development with present condition of administration moral system in the United States, the method of administration moral legalization of Hong Kong. Then it objective takes them into the critique, inherits by judgment, and brings forward some inspirations to administration ethics construction by rule of law.The fifth part tries to suggest four measures, such as enhancing the administration morals lawmaking, perfecting nation public official's system, fostering the moral notion of the public administration and modifying the supervisory mechanism in administration.The innovation of this thesis is to put forward own way of thinking and studying administration ethics construction by rule of law, which concerns the realms of Public administration, Ethnics and Law. It is beneficial for the administration management to orient the demand of market economy and the new public administration.
