A Study Of Criminal Decision In Perspective Of Psychology

Crime is the public enemy of the civilized societies, is the serious comtempt and disruption of social order. As wei ping-xiong, who is a professor of criminology of china university of political science and law says:"we are experiencing the fifth criminal peak since we established our state." So it is of great significance to strengthen the research of criminal psychology that is different from criminal jurisprudence. On the one hand, it can enrich the theory system of psychology; On the other hand, it actually helpful for anti-crime,combating crime and reforming crime. As an independent psychological course, criminal decision engenders after the emerging of criminal motivation before the implementing of criminal action. It includes:determination of criminal goal; choice of guilty methods and the accepting or rejecting the motivation of crime or abiding by the law. It is no doubt that offense decision is an important question for study of criminal psychology. This article based on the summary of the research records present conditions of criminal psychology and research fruit of offense decision of home and broad, if put forward a theory hypothesis of "Rational criminal decision". Which believes that: offence decision process is a careful consideration for most of criminal, offence decision should be an activity operated behavior of hesitating-choosing and not passive response of stimulus-reaction. Then, starting from the theory hypothesis and combining with the conversation of criminals. The author worked out "offence decision questionnaire". Through examination and measuring of specialists, finally formal questionnaire has been worked out. a coefficient and split-half reliability coefficient of this scale reach into 0.8774 and 0.8286. At last, the author measured 450 criminals with it. The outcome of factor analysis and cluster analysis of these statistics shows that: â…  The factors that influent on criminals offence decision have four types (1) Unhealthy psychological factors. (2) Psychology evaluation factors of offense decision. (3) Outer control factors.(4) Irrational elements of offense decision;â…¡The score of different group has no difference significance in moral level and acceptance of positivism law education. But from gender and residence empiriasm the scores has different significance. Finally, this article verified Eysencks "Criminality theory" with empirical method. The result shows that the result of our research doesn't support the theory. It indicated that this theory must be tested further or there is no distinguished criminal characters which exist in the criminal groups in our country recently. According to the research, we suggest that: (1) we should discover and transform harmful psychological factors in time, which is belong to latest criminals, and release it effectively in order to avoiding occurrence of criminal behavior. (2) we should strengthen education and legal system, and should manage enforcing law strictly in order to smashing their idea of trusting to luck as possible as we can, so they can recognize meshes of the law. (3) we should perfect social controlling system, so criminals cannot find the right chance to do the wrongs.
