As a unique legal system of China, reeducation through labor system has more than50years of history. In spite of its nature as a change to the object has changed, the purpose of the system which is "education, probation, change " has not been changed.However, with the Chinese legislation process moves forward, many of the problems and deficiencies in reeducation through labor system is also increasingly exposed. There are many doubts about the legality of reeducation through labor system. And it lead to "Save" and "waste" heated controversy. Especially after the introduction of "drug law", reeducation through labor system is facing new situation.In recent years, the theory circle and practice circle have been put forward many solutions about the reform of the reeducation through labor system, which each have advantages also have defects.However, for our next step to advance the system of reeducation through labour reform will be of great advantage. In the opinion of the author, the system of reeducation through labor has the shortcomings and deficiencies, but still has its value and meaning of existence. We should carry on the reform based on promote the rule of law and protection of human rights.With betain and give full play to the system of the reasonable kernel, we should make efforts to establish a Chinese characteristic education correction system.Under this article the implementation of this background of the past four years in the Drug Law, by browsing the history of the reeducation through labor system, the analysis of the realities faced by the re-education through labour system, combined with Security Measure System, put forward some suggestions for the improvement of China’s reeducation through labor system.
