The Research On Legislation Of Administrative Permission

The administrative permission system, as a way of the country's micromanagement of social and economic activities, must be affected and restricted by the conceptions, regulations and methods and style of the whole permission system. With,the development of socialist market economy, the actual permission system have most problems, which not only make a lots official corruption, but also hinder the healthy development of the market economy seriously. It is, necessary and urgent to deeply analyze and research on the actual administrative permission system, and find the existing problem and improve it. This paper mainly takes up the following questions.Firstly, to elucidate and analyze the defmation, scope and the basic regulation of the permission system in brief, which prepare the theoretical basis for the research.Secondly, to discuss the existing problems of our country's permission system. The thesis analyze the present problem in the light of practice which the scope and enactment, permission condition and standard, organization and authority, permission process, permission charge, supervision and management.Thirdly, to analyze the necessity of improvement of the permission system.It mainly clarify the need from three aspects which of the economic development, investment environmental improvement and adaptation of the WTO's regulations.Finally, to discuss how to perfect the present permission system. It research emphatically two sides of the permission system of formulation and improvement.On the formulation study, it considers the problem of the subject, enacting authority, condition, process, charge, and supervision of the permission. On the improvement aspect, it proposes some topical issues, such as to reduce permission and to improve the ability and efficiency of the government's staff.
