Copyright Of Digital Information Resource

Object: The development, application of digital technology and network transmit technology have changed thoroughly the survival environment. As the changing of manner by which the information resources have been produced, distributed, collected, transmitted and utilized, the status, the right and the obligations of interested parties have been changed. With view to the copyright of digital information resource (DIR), and basing ourselves on digital library realities, through discussing the correlative foundamental conceptions, and discussing the success and failure, researcher will try hard to define the important conceptions about DIR, and make every effort to bring forward the projects to perfecting the copyright law of China.Methods: Conforming the internationalization of copyright protectionism, this study has taken the WIPO Copyright Treaty (WCT), The Digital Millennium Copyright Act (DMCA), and The Copyright Law of China as the compared objects, this study has chosen ten cases as the analytical materials, and the follow study methods has been used, such as literature search and analysis,compare, cases analysis, synthesis and induction, et al.. The digital right, the network transmitting right, the copyright of database, the liability for tort of Internet Contents Provider (ICP) and Internet Service Provider (ISP), the copyright collective have been discussed. This study has analysed and reviewed the chosen cases. WCT, DMCA and the Copyright Law of China has beencompared in this study. Finally, the study analysed the copyright problems bom in the course of the development of digital library. Conclusion: (1) For the first time, this study defines the digital right as a special independent right, closing to publish right. (2) For the first time, this study defines the network tranmitting right as a new complex right, having the characters of copy (or print) and distributing. (3) For the first time, this study provides a new concept: "library combo". (4) This study has emphasized the mechanism for protecting the database special right, and provided the vote for legislation.
