Discuss The Lawyer And Justice

This article imposed a comprehensive, systematic and penetrating discuss upon the lawyer and justice. The author analyzed the meaning and intension of justice ( i.e. entity justice and procedure justice ) from the angle of a law practitioner, which stressed the significance of it. With the birth and development of western lawyer's system, which highly paid attention to the lawyer's function in promoting the elisor and even domestic politics., the transient development history of Chinese lawyer's system indicated that the lawyer's system developed with the advance of democracy and legal system. Involved in the judicial field, the lawyer played a positive role on the justice, such as: to restrict the judicial power and defend human rights, to advance the progress of democratic politics, to promote the correct understanding and application to the law of the whole society and to fill in the legal blank. It was so imperative to perfect the lawyer's system that the lawyer could function in justice. In view of this, the author tabled his proposals, for example, to determine the nature and status of the lawyer, to establish the status of the lawyer's defence rights, to improve lawyer's own qualities and to perfect the related systems. Also, some heatedly discussed isusses in judicial lawsuit and lawyer industry in recent years were concerned in this text, which I believe will be beneficial to the judicial practice.
