The Research On The Social Responsibility Of The Lawyer In The Perspective Of Legal Sociology

In the continuous process of social development, each kind of occupation, even everyindividual is playing a role in society at all times, shouldering certain responsibilities of therole in society who should take. Lawyer has experienced thousands of years of history as asocial role, but was legally recognized as a legitimate social professional, which is the productof the bourgeois revolution to overthrow the feudal autocratic rule and establish democracy.Lawyer belongs to the tertiary industry in the service industry, but is related to the socialpublic rights and development of national and social politics, economy, culture in terms oftheir social service contents and properties. The lawyer has become the key force ofmodernization and construction of democracy and the rule of law, and its importance isself-evident. From the angle of view of Sociology of law，the study of social responsibility ofthe lawyer not only plays an important role in establishing the role of lawyers andpromoting social function of lawyers, but also plays a irreplaceable role in the continuousdevelopment of our socialist construction and in good interactive activities between thepolitical country and the citizen society.The thesis is divided into five main parts which tell the issues about social responsibilityof lawyers. The first part is the introduction. It tells the background, the goal, the creativeparts as well as the methods of research. The body of the thesis includes four chapters.The first chapter makes the research of basic theories of the social responsibility of thelawyer. Firstly, it makes the description of the different definition of the lawyers. Then thewriter gives his own definition of this role. Secondly,it gives the analysis of nature of thelawyers in some aspects and makes the conclusion that the role meets the demand of thedevelopment of the society ruled by law which the lawyers play as the legal role ofworkers.Lastly, the passage makes responsibility, social responsibility and the socialresponsibility of lawyers clearly, and based on which the writer makes further analysis of thedifferences between the occupational duty of the lawyer, legal responsibility and socialresponsibility. The definition of the social responsibility of the lawyers is the starting pointand end point of the passage. it is also regarded as the key issue discussed. It paves the wayfor further discussion later.In the second chapter, on the basis of having a clear understanding of the key concepts,the thesis studies social foundation and the specific content of social responsibility of lawyers. The establishment of a clear market economy, the formation of democratic politics and legalculture is the necessary social environment where social responsibility of the lawyer can berealized. And then, it discusses several aspects involving in social responsibility of lawyersthrough the definition of social responsibility of lawyers, including safeguarding socialfairness and justice; advancing the system construction of the state and political progress;publicizing laws, law education and reflecting the interests of all social sectors and etc.The third chapter, from multiple perspectives, analyzes the obstacles that exist in theprocess of our lawyers to fulfill their social responsibility, subjective and objective. Not onlythe lawyers in our country experienced several rough fate, but also the formal law systemstarted late, coupled with our history, politics, culture, and social factors, there are manyinadequacies in awareness, social environment and political system for the lawyers to fulfilltheir social responsibility. This will greatly hinder the realization of social responsibility.Chapter Four raise some suggestive comments from two main angles separately, whichare the role of lawyers in the individual subjective factor and the social, political and legalsystem of objective factors. And it hopes lawyers in our country can take the socialresponsibility actively, in order to live their name of” legal person” in public vision.The thesis cuts into topic from the aspects of role in legal and society, and effectivelyanalysis the role of lawyer on the background of the whole social environment, and in thisway, it discusses the lawyer’s social responsibility.It focuses on building up the value systemof social responsibility, and expect to play a guiding role in practice.
